HomeMy WebLinkAbout2014-047 Council ResolutionCITY OF LINO LAKES RESOLUTION NO. 14-47 RESOLUTION APPROVING THE PUD FINAL PLAN/FINAL PLAT FOR NORTHPOINTE WHEREAS, the City has received an application for PUD Final Plan/Final Plat approval for NorthPointe hereafter referred to as "Development"; and WHEREAS, City staff has completed a review of the proposed "Development" based on the following plans and information: • Revised PUD Development Stage Plan/Preliminary Plat revision date April 28, 2014 prepared by Carlson McCain • Grading, Development & Erosion Control Plans revision date April 28, 2014 prepared by Carlson McCain • Sanitary Sewer, Watermain, Storm Sewer and Street Reconstruction Plans revision date April 24, 2014 prepared by Carlson McCain; and WHEREAS, a public hearing was held before the Planning & Zoning Board on December 11, 2013 and continued to the February 12, 2014 meeting and the Board recommended approval of the PUD Development Stage Plan/Preliminary Plat; and WHEREAS, the City Council approved the rezoning from R, Rural to PUD, Planned Unit Development with Ordinance 02-14 and the PUD Development Stage Plan/Preliminary Plat with Resolution 14-21; and WHEREAS, Planning & Zoning Board reviewed and recommended approval of the PUD Final Plan/Final Plat at the May 14, 2014 meeting; and WHEREAS, the proposed development is not considered premature and meets the performance standards of the subdivision and zoning ordinance; and WHEREAS, the final plat is consistent with the preliminary plat; and NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Lino Lakes hereby approves the PUD Final Plan/Final Plat of NorthPointe, subject to the following conditions: 1. All comments from City Engineer letter dated May 8, 2014 shall be addressed. 2. All comments from Environmental Coordinator letter dated May 7, 2014 shall be addressed. 3. All comments from MnDOT letter dated May 13, 2014 shall be addressed. 4. The following executed documents shall be recorded with Anoka County within 90 days of City Council approval of final plat: a. Final Plat b. Development Contract & Planned Unit Development Agreement c. Conservation Easements i. Conservation Easements shall be approved by RCWD and the City. ii. Conservation easement language shall include allowance for construction of trails, parks, storm water management facilities, retaining walls, etc. d. Homeowner's Association documents i. The HOA documents shall be reviewed and approved by the City. e. Deed for Outlot A i. Outlot A of the NorthPointe final plat shall be deeded to the City. ii. The developer shall prepare the deed for Outlot A. 5. The following executed document shall be approved by the City Council prior to issuance of a Grading Permit: a. Development Contract & Planned Unit Development Agreement 6. The following items shall be submitted to the City prior to issuance of a Grading Permit: a. Revised plans based on staff comments. b. Executed Declaration for Maintenance of Storm Water Facilities. c. NPDES Permit. d. RCWD Permit. e. Securities and Escrows as detailed in the Development Contract. f. Grading Permit Fee of $150. g. A copy of the Conditional Letter of Map Revision (CLOMR) application sent to FEMA. 7. The following items shall be submitted to the City prior to issuance of a Building Permit: a. Revised plans based on staff comments. b. An electronic PDF of the final approved plans. c. Building Permit Fee as determined by the Building Official. d. An as -built survey of the grading. e. A Letter of Map Revision (LOMR) from the Federal Emergency Management Agency (FEMA) for parcels located within the floodplain. 8. Approval from Rice Creek Watershed District shall be required prior to recording the final plat. 9. The developer shall grade the park in accordance with the approved grading plan and provide top soil and seed per City specifications. 10. A detail of the proposed boulevard median on Red Oak Lane including landscaping and signage location shall be provided. 11. A Sign Permit shall be submitted by the developer and approved by the City for the proposed subdivision monument sign located in the boulevard median on Red Oak Lane. 12. Grading, Development and Erosion Control Plans, Sheets 5-7: a. Landscaping berm along I -35E shall be increased to a height of 15 feet. b. Landscaping berm along CSAH 54 shall be increased to a height of a minimum 3 feet and be continuous from Lot 21 to 30. 13. Preliminary Plat -Plan Set, Sheet 3 -Preliminary Plat Index: 2 a. The sheet shall be revised to reflect the correct Site Data related to Exemption Area and Wetland Area. 14. Preliminary Plat -Plan Set, Sheet Ll -L2 -Planting Plan: a. Landscape plantings on the berms along I -35E shall be provided. b. A cross section of the berms with landscape plantings shall be provided. c. The Planting Plan shall reflect the changes in berm heights and continuous design along CSAR 54. 15. One full size set of the revised plan sets shall be submitted to the City. 16. One electronic copy of the revised plan sets shall be submitted to the City.
