HomeMy WebLinkAbout2014-130 Council ResolutionCITY OF LINO LAKES �..� RESOLUTION NO. 14-130 AUTHORIZING PROFESSIONAL SERVICES CONTRACT WITH WSB AND ASSOCIATES FOR THE UPDATE OF THE I35E CORRIDOR ALTERNATIVE URBAN AREAWIDE REVIEW WHEREAS, the City Council, as the Responsible Governmental Unit, authorized the preparation of an Alternative Urban Areawide Review (AUAR) with Resolution No. 05-51; and WHEREAS, the City prepared a Draft I -35E Corridor AUAR document and the City Council authorized distribution it for public comment with Resolution No. 05-85; and, WHEREAS, the City distributed the I -35E Corridor Final AUAR as authorized by the City Council with Resolution No. 05-144; and WHEREAS, the City Council adopted the Final AUAR with Resolution No. 05-159; and WHEREAS, MN Rules require an update of the AUAR every five years after the adoption of the original AUAR; and WHEREAS, the AUAR was last updated in October of 2010, and WHEREAS, WSB & Associates, has submitted a proposal to perform such services; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO LAKES, MINNESOTA: 1. That staff is authorized to enter into an agreement with WSB & Associates to update the 1- 35E Corridor Alternative Urban Areawide Review in the amount of $15.200. Adopted by the Council of the City of Lino Lakes this 10th day of November, 2014. As you know, to remain valid as the environmental review for the area, the AUAR needs to be updated every five years. The City's last update to the AUAR for the area will expire in October 2015. Task 1- Collect and Analyze Background Information Background information, including the original AUAR, 2010 AUAR Update, and any relevant studies that have been completed in the area since the last update will be collected and analyzed. This will include reviewing City documents as well as Watershed District rules. This will assist in developing the framework for the needed updates to the study. Additionally, updated data from the various agencies such as the DNR Natural Heritage Database, Minnesota Pollution Control Agency, and Minnesota Historical Society will be obtained. Task 2 - Review Development Scenarios The AUAR evaluated three development scenarios. These scenarios will be reviewed with the Comprehensive Plan and any changes or updates summarized in the document. Task 3 - Update AUAR The original AUAR and AUAR Update are very complete and many portions of these documents are still valid. Overall, the AUAR will be updated to reflect new rules or regulations. Mitigation measures will also be updated to reflect any new rules or regulations where applicable, or identify if any of the measures have been implemented. The AUAR Update will be a separate document that references the original AUAR and 2010 Update, analyzes was has changed since the AUAR, and updates the mitigation measures as necessary. While all sections of the AUAR will be reviewed and updated, if needed, specific scope items related to the larger sections of the AUAR are summarized below. Lakes \AUAR \LTR - 101014 - ngrochaladocx October 10, 2014 Page 2 Traffic The traffic mitigation measures will be reviewed, and updated if needed, based on implementation of past road improvements or other studies. The scenarios reviewed represent a "worst case" scenario, so additional traffic study is not anticipated with this task. Storm Water Management The storm water mitigation section will be updated to reflect the new storm water regulations that have changed since 2010. No additional modeling is anticipated with this work. Water supply/ Wastewater The water supply and wastewater sections will be reviewed and updated in relation to the City's Comprehensive Plan and any projects that have been completed. Task 4 - Review and Submit for Comment Period The Update will be reviewed with City Staff. Progress updates will be provided to staff throughout the process. This task includes one round of revisions based on City Staff review. The document will then be submitted to the agencies for the 10 -working day comment period. If objections are filed, we will work with the City to address these on an hourly basis. If no objections are filed, the Update will go to City Council for adoption. This task includes preparing written responses to agency comments as well as attendance at one City Council meeting. Task 5 - Update Cheat Sheet and Mitigation Check List Based on the Update, the "cheat sheet" will be revised and a mitigation check list will be created. This will assist City staff in development plan reviews as they come in to review the plans in relation to the commitments in the AUAR. Cost Estimate The cost to complete the above work plan for the AUAR Update is estimated at $15,200. The AUAR Update does not expire until October 2015, so there is room in the schedule to complete the document. That said we anticipate completing the update over the winter and could have a draft to the City Staff within 3-4 months of authorization. BACKGROUND The I -35E Corridor Alternative Urban Areawide Review (AUAR) is an environmental review document that analyzed potential impacts of development within a study area of 4660 acres. The City of Lino Lakes prepared the AUAR in accordance with MN Rules 4410. The final document was adopted by the Lino Lakes City Council on October 24, 2005. The AUAR serves as a substitute environmental review. As long as a development project is consistent with the assumptions of the analyses in the AUAR, no additional environmental review is required. In order to remain valid as a substitute form of environmental review, the AUAR must be revised under certain criteria. One of the criteria is the passing of five years. The AUAR was last updated in October of 2010. Since that time the City's 2030 Comprehensive Plan was adopted. Transportation improvements including the reconstruction of the 35E/CSAH 14 Interchange, and extensions of both Otter Lake Road and 21st Avenue to the north of Main Street have been completed. New development has also begun to take place within the corridor including McDonald's, Northern Wholesale expansion, the Metro Transit Park and Ride and the NorthPointe residential development. WSB and Associates have prepared a proposal to complete the update in the amount of $15,200. Funding for this project is included in the Planning and Zoning contracted services budget. The City does collect an AUAR fee of $269 per acre for all new development within the corridor off set the administrative costs associated with the document.
