HomeMy WebLinkAbout2014-132 Council ResolutionCITY OF LINO LAKES RESOLUTION NO. 14-132 APPROVING PRELIMINARY PLAT FOR LINO LAKES DEVELOPMENT WHEREAS, the City has received a land use application for Preliminary Plat for Lino Lakes Development hereafter referred to as "Development"; and WHEREAS, City staff has completed a review of the "Development" based on the revised plan set dated October 14, 2014 prepared by River Valley Architects and CEI Engineering Associates and received by the City on October 15, 2014; and WHEREAS, a public hearing was held before the Planning & Zoning Board on October 8, 2014 meeting and the Board recommended approval of the "Development"; and WHEREAS, the "Development" is in compliance with the City's Comprehensive Plan, Zoning and Subdivision Ordinances and other land use controls as detailed in the Planning & Zoning Staff Report dated October 8, 2014; and WHEREAS, Ordinance No. 11-14 to rezone the property from GB, General Business to R-4. High Density Residential was approved by the City Council; and WHEREAS, Resolution No. 14-133 to allow for a conditional use permit for an assisted -living facility was approved by the City Council; and WHEREAS, the regulations and performance standards of the zoning ordinance and R-4 High Density Residential District will be in effect unless otherwise stated in this resolution; and WHEREAS, a land use application for Final Plat and a Development Contract shall be required. NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino Lakes hereby approves the preliminary plat for Lino Lakes Development, subject to the following conditions: 1. All conditions of Resolution No. 14-133 approving the conditional use permit shall be met prior to approval of the final plat. Adopted by the Council of the City of Lino Lakes this 10th day of November, 2014. Consider Resolution No. 14-133, Approving Conditional Use Permit for Assisted -Living Facility VOTE REQUIRED: 3/5 INTRODUCTION Complete Application Date: September 8, 2014 60 -Day Review Deadline: November 7, 2014 120 -Day Review Deadline: January 6, 2015 Environmental Board Meeting: September 24, 2014 Park Board Meeting: October 6, 2014 Planning & Zoning Board Meeting: October 8, 2014 Tentative City Council Work Session: November 3, 2014 Tentative City Council Meeting: November 10, 2014 Council consideration is requested for the following land use applications: • Rezoning from GB, General Business to R-4, High Density Residential • Preliminary Plat, Lino Lakes Development • Conditional Use Permit (CUP) for assisted -living facility BACKGROUND The project involves the construction of a 21,118 s.f., 39 -unit assisted -living facility named White Pine Senior Living to be located at the southeast corner of 77th Street West and CSAH 23/Lake Drive. The facility includes 39 resident rooms, commons areas, dining room, activity rooms, kitchens, toilet/shower rooms, mechanical spaces and other general support spaces. The proposed construction is slab -on -grade with frost depth foundations, conventional wood framed walls and wood truss roof system. The site is the former location of Schwan's Sales Enterprises. The Planning & Zoning Staff Report dated October 8, 2014 details the proposed project. The Planning & Zoning Board held a public hearing on October 8, 2014. One public comment was made by the operator of the auto repair facility north of the project regarding noise from his operation and drainage concerns along 77th Avenue. The Planning & Zoning Board recommended approval of the project. The most current plan set was prepared by River Valley Architects and CEI Engineering Associates, Inc. dated October 14, 2014 and received by the City on October 15, 2014. Preliminary Plat The preliminary plat is titled Lino Lakes Development. The project requires the platting of two (2) existing parcels and dedication of right -of way along 77th Street and Lake Drive (CSAH 23). The resulting plat will create Lot 1, Block 1, Lino Lake Development. The preliminary plat meets the criteria of the subdivision ordinance as detailed in Resolution No. 14-132. Rezoning The parcels are currently zoned GB, General Business and shall be rezoned to R-4, High Density Residential which allows for clinics, hospitals and nursing homes with a conditional use permit. The proposed assisted -living facility is comparable to a nursing home from a land use and zoning perspective. The Planning and Zoning Board held a public hearing and found the proposal meets the criteria for rezoning as detailed in Ordinance No. 11-14. Conditional Use Permit The property is currently zoned GB, General Business and shall be rezoned to R-4, High Density Residential which allows for clinics, hospitals and nursing homes with a conditional use permit. The Planning & Zoning Board held a public hearing and found the proposal meets the criteria for a conditional use permit as detailed in Resolution No.14-133. Site Plan Review The Site Plan Review Worksheet found in the Planning & Zoning Staff Report dated October 8, 2014 provides detailed information regarding the site plan review. The development meets the performance standards of the subdivision and zoning ordinance with some minor revisions required. Comprehensive Plan The proposed assisted -living facility is in compliance with the Comprehensive Plan in terms of Resource Management System, Land Use Plan, Housing Plan, and Transportation Plan. Although the density of the proposed assisted -living facility is 16.46 units per acre which is greater than the suggested 15 units per acre, the facility functions as both residential and commercial (e.g. employers, delivery vehicles, emergency vehicles etc.). Flexibility shall be allowed for 16.46 units per acre. Final Plat A land use application and fees for Final Plat shall be required. At such time, the developer shall enter into a Development Contract, Stormwater Maintenance Agreement and other documents as the City deems necessary. RECOMMENDATION The Planning & Zoning Board and staff recommend approval of the preliminary plat, rezoning, conditional use permit and site plan review for White Pines Senior Living -Lino Lakes Development subject to the conditions listed in the attached resolutions.
