ORDINANCE NO. 11-14
ORDINANCE TO REZONE CERTAIN REAL PROPERTY FROM GB,
GENERAL BUSINESS TO R-4,HIGH DENSITY RESIDENTIAL FOR
WHITE PINE SENIOR LIVING
"The City Council of Lino Lakes ordains".
Section 1
The City of Lino Lakes makes the following Findings of Fact:
1. The City received a Land Use Application to rezone certain property from GB,
General Business to R-4, High Density Residential.
2. The Planning and Zoning Board held a public hearing on October 8, 2014.
3. The proposed action has been considered in relation to the specific policies and
provisions of and has been found to be consistent with the official City
Comprehensive Plan.
The proposed assisted-living facility has been reviewed for compliance with the
comprehensive plan and is consistent for mixed use residential development as noted
in the staff report. Goals of the Housing Plan include improving availability of
affordable and life-cycle housing and enhancing opportunities for senior housing.
Assisted-living facilities are considered housing units. Although the density of the
proposed assisted-living facility is 16.46 units per acre which is greater than the
suggested 15 units per acre, the facility functions as both residential and commercial
(e.g. employers, delivery vehicles, emergency vehicles etc.) Flexibility shall be
allowed for 16.46 units per acre.
4. The proposed use is or will be compatible with present and future land uses of the
area.
The proposed assisted-living facility is compatible with present and future land uses.
The property to the north across 77th Street is zoned rural and is guided for
commercial use. Currently, a residential home with an auto-repair business exists on
the site. The property to the east is zoned general business and guided for mixed use.
Currently, a residential home exists on the parcel. The property to the south is zoned
and guided for commercial development. The Market Place commercial development

�✓ exists to the south. The property to the west across CSAH 23 is zoned NB,
Neighborhood Business and is guided for commercial use. Currently, 2 (two)single
family homes exist west of the highway.
5. The proposed use conforms with all performance standards contained herein.
A Site Plan Review has been completed and the proposed facility meets zoning
performance standards in regards to lot size, width and length as well as landscaping
and parking with the approved conditional use permit.
6. The proposed use can be accommodated with existing public services and will not
overburden the City's service capacity.
The site is served by a 12"ductile iron watermain located along CSAH 23 and a 10"
sanitary sewer line located along 77`h Street. Both public utilities can accommodate
the demands of the facility.
7. Traffic generation by the proposed use is within capabilities of streets serving the
property.
CSAH 23 is an "A"minor arterial reliever road. 77`h Street and Market Place Drive
are local roads. The main entrance to the site is from CSAH 23 to Market Place
Drive which is a signalized intersection capable of handling traffic to and from the
development. A secondary driveway access is provided off of 77`h Street; however,
the right in-right only onto 771
h Street from CSAH 23 will limit traffic use on 77`h
Street. Minimal traffic will be generated from the 4-8 staff persons, visitors and one
time per week deliveries.
Section 2
The Zoning Ordinance of the City of Lino Lakes is hereby amended to rezone the
following described property from GB, General Business to R-4, High Density
Residential:
Parcel A:
That part of the South Half of the Southeast Quarter of Section 8, Township 31, Range
22,Anoka County,Minnesota described as follows: Beginning at a point on the North
line of said South Half of the Southeast Quarter distant 1587.48 feet West of the
Northeast corner thereof;thence South at right angles a distance of 201 feet; thence West
parallel with the North line of said South Half of the Southeast Quarter and to the
Easterly right-of-way line of State Trunk Highway No. 8;thence Northeasterly on said
Easterly right-of-way line to its intersection with the North line of said South Half of the
Southeast Quarter;thence East on said North line of the point of beginning.

Quarter, a distance of 1380.70 feet,to the actual point of beginning of tract to be
described;thence at a right angle to the North line, South 00 degrees 18 minutes 37
seconds West, 233.00 feet;thence at a right angle,to the left,North 89 degrees 41
minutes 23 seconds West, 500.57 feet, more or less,to the Easterly line of Anoka County
Highway Right-of-Way Plat No. 17;thence Northeasterly along said Easterly line, on a
curve whose radius is 5641.85 feet, a central angle of 00 degrees 21 minutes 52 seconds,
a distance of 35.88 feet, more or less,to its intersection with the South line of the North
201 feet of said South Half of the Southeast Quarter;thence South 89 degrees 41 minutes
23 seconds East, parallel with North line of said South Half of the Southeast Quarter,to a
point of intersection, said point of intersection distance 1587.48 feet West of the
Northeast corner of said South Half of the Southeast Quarter, and 201.00 feet Southerly
at a right angle to said North line;thence North 00 degrees 18 minutes 37 seconds East,
on said right angle line, 201.00 feet, to the North line of said South Half of the Southeast
Quarter; thence South 89 degrees 41 minutes 23 seconds East, 206.78 feet,to the actual
point of beginning.
All being part of Lot 15, Auditor's Subdivision No. 134.

Section 3
The development shall conform to the plans, requirements, and conditions of approval as
listed in Resolutions No. 14-132 and No. 14-133 and associated information.
Section 4
This ordinance shall be in force and effect from and after its passage and publication
according to the Lino Lakes City Charter.
Adopted by the Lino Lakes City Council this 2 4 day NovembeQ014.
