Council Member Roeser moved for adoption of the following ordinance:
CITY OF LINO LAKES
ORDINANCE NO.2-12
AN ORDINANCE AMENDING THE PLANNED UNIT DEVELOPMENT FOR THE
LEGACY AT WOODS EDGE (LINO LAKES TOWN CENTER) AS CREATED BY
ORDINANCE 04-04, TO ALLOW CERTAIN OFFICE USES IN THE CIVIC DISTRICT.
The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain:
SECTION 1 FINDINGS
The City Council makes the following findings regarding the application for amending
the Planned Unit Development for the property described below, based on the
factors listed in Section 2, Subd.1E of the Lino Lakes zoning ordinance:
1. The proposed action has been considered in relation to the specific policies
and provisions of and has been found to be consistent with the official City
Comprehensive Plan, as the site is guided for mixed uses.
2. The proposed use is or will be compatible with present and future land uses
of the area. The site is guided for mixed uses. Land in the area of the site is
already developed with mixed uses or designated for such use.
3. The Lino Lakes Town Center Design & Development Guide contains
specific performance standards that will apply to any office use that is
proposed within the Planned Unit Development area.
4. The proposed use can be accommodated with existing public services and
will not overburden the City's service capacity. The properties guided as
Civic are served by sufficient transportation and utility systems to support
these uses.
5. Traffic generation by the proposed use is within capabilities of streets
serving the property in conjunction with the public improvements proposed.

The Planned Unit Development for the Legacy at Woods Edge (Lino Lakes Town
Center) as approved by Ordinance 04-04 is hereby amended as follows:

SECTION 2 DISTRICT PROVISIONS
A. Table 1 of Section 3.1 (Allowable Uses) of the Lino Lakes Town Center Design &
Development Guide, attached to Ordinance 04-04 as Exhibit B, shall be
amended to include two office uses as permissible uses within Civic Districts.

Second Reading of Ordinance Number 2-12
Planned Unit Development Amendment to add certain
office uses as permitted uses within the civic district of the
Lino Lakes Town Center.
VOTE REQUIRED: 4/5
INTRODUCTION
The Early Childhood Family Education program will be moving out of the City Hall complex,
resulting in an open tenant space. Staff has been working to develop opportunities for potential
tenants and the City Council has voted to engage a broker to continue the search. Staff has
initiated this amendment to maximize the market potential for the tenant space.
BACKGROUND
The City Hall Complex is located within the boundaries of the Lino Lakes Town Center which
was established as part of a Planned Unit Development (PUD), and therefore the Town Center
Design & Development Guide regulates the uses that would be allowed within the complex. The
site is designated as Civic (only City Hall and the YMCA properties are designated as Civic),
and the Civic district includes the following permanent uses as permitted uses:
• Health clubs and gymnasiums
• Outdoor recreation facilities
• Community -serving centers
• Semipublic facilities
• Indoor recreation facilities
• Concession stands (not exceeding 500 square feet)
• Cultural facilities
• University, college, and professional schools
While the semipublic facilities allowance would open up occupancy of the tenant space for other
government or quasi -government offices, staff is proposing to allow other office uses in the civic
district by expanding the following two uses (already included in the guide) to be permitted in
the civic district:
• Professional services including medical & health offices & clinics, engineering & design
services, legal and counseling services, but excluding laboratories, hospitals, sanitariums
and rest homes.
• Finance, insurance & real estate services, including security & commodity brokers &
dealers, insurance & real estate agents, and brokers; not including banks, savings &
loans, & credit services.
RECOMMENDATIONS
On January 11, 2012 the Planning and Zoning Board discussed the proposed amendment,
ultimately recommending approval of the ordinance changes on a 4-1 vote.
Staff recommends approval of the second reading of Ordinance Number 2-12.
