ORDINANCE NO. 16-11
AN AMENDMENT TO TITLE 1000 OF THE CITY CODE OF
LINO LAKES, MINNESOTA.
AN EMERGENCY ORDINANCE AMENDING CHAPTER 1012 BY ADDING THE
MINNESOTA ELECTRICAL ACT TO THE CITY CODE
The City Council of Lino Lakes ordains:
SECTION 1: AMENDMENT
Chapter 1012 of the Lino Lakes City Code is hereby amended by adding the Minnesota
Electrical Act to the City Code which shall read as follows:
1012.01. PURPOSE
The purpose of this amendment is to establish an electrical inspections program in the
City of that is administered and enforced by the City.
1012.01. AUTHORITY TO INSPECT.
The City of Lino Lakes hereby provides for the inspection of all electrical
installations, pursuant to Minn. Stat. § 326B.36. subd. 6.
1012.02 ADOPTED BY REFERENCE.
The Minnesota Electrical Act, as adopted by the Commissioner of Labor and
Industry pursuant to Minnesota Statutes Chapter 326B, Sections 326B.31 to 3266.399.
The Minnesota Electrical Act is hereby incorporated into this ordinance as if fully set out
herein. The Minnesota State Building Code incorporates by reference the National
Electrical Code pursuant to Minn. R. 1315.0020. All such codes incorporated herein by
reference constitute the electrical code of the City of Lino Lakes.
1012.03 COMPLIANCE.
All electrical installations shall comply with the requirements of the electrical code
of the City of Lino Lakes and this ordinance.
1012.04. PERMITS AND FEES.
The issuance of permits and the collection of fees shall be as
authorized in Minnesota Statutes 326B.37. Any inspection or handling fees
will be payable to the City of Lino Lakes. Fees shall be established by
ordinance of the City Council.
1012.05. NOTICE AND APPEAL.
All notices of violations and orders issued under this ordinance shall be in
conformance with Minn. Stat. § 326B.36, subd. 4.
1012.06. VIOLATIONS AND PENALTIES.
A violation of the Minnesota Electrical Act is a misdemeanor. (M.S.
326B.082, subd. 16).
1012.07. SUNSET.
This ordinance shall be revoked without further action of the city council
once the Department of Labor and Industry is funded for the 2011 fiscal year by
legislative enactment of a state budget.
SECTION 2. FEE SCHEDULE
That the City Fee Schedule be amended in accordance with Exhibit A attached
hereto and made a part hereof.
SECTION 3: EFFECTIVE DATE
This ordinance shall be in force and effect from and after its passage according
to the Lino Lakes City Charter.

ACTION REQUIRED: Simple Majority
BACKGROUND:
The lack of an adopted state budget in 2011 has resulted in a temporary suspension of
many state functions. One of these directly effecting Lino Lakes is the suspension of
electrical inspections. Under state law, any new electrical installations in virtually any
construction, remodeling, replacement or repair must be inspected for compliance with
accepted standards of construction for safety to life and property. Due to the state
shutdown current construction projects may be delayed due to the suspension of
inspections.
To avoid this possibility the City may enact an emergency ordinance to establish an
electrical inspection program administered by the City. Ordinance 16-11 is being proposed
for this purpose until such time as a state budget is enacted and services are resumed.
Under this proposal electrical inspection would be provided under contract by David
Kichler Inspections. Mr. Kichler is currently providing services to Lino Lakes as a
contractor with the State and also provides electrical inspection services on a contract
basis to neighboring cities including Hugo and Centerville.
Due to the lack of inspection services Ordinance 17-11 is considered an emergency
ordinance under the provisions of the City Charter. Accordingly the ordinance will go
into effect immediately upon passage.
RECOMMENDATION:
Staff is recommending approval of Ordinance No. 17-11 and Resolution No. 11-74.
