The City Council of The City of Lino Lakes do ordain as follows: Section 1. That the Lino Lakes Code of Ordinances Chapter 503 be amended to read as follows: CHAPTER 503. ANIMAL CONTROL REGULATIONS 503.01 DEFINITIONS. KENNEL, PRIVATE. Any structure or premises on which between 3 (three) and 4 (four) dogs, over six months of age, are kept for private enjoyment and not for monetary gain. 503.09 LICENSE AND VACCINATION REQUIREMENTS: 2. Limitations. No more than twe three (3) dogs over six (6) months of age shall be kept on a property except as provided for in Section 503.10. 503.10 KENNEL LICENSES: COMMERCIAL AND PRIVATE. 1. General. Any person who owns, keeps, or allows the keeping of more than twe three (3) dogs over six months of age on any parcel of land must first acquire a kennel license from the city. A person who owns or operates a commercial kennel or a private kennel must renew the license annually and comply with applicable requirements herein. Section 2. Effective Date. This ordinance shall be in full force and effect from and after 30 days following its passage and publication, in accordance with Section 3.09 of the City Charter. Pecchia, Public Safety Director MEETING DATE: January 12, 2009 TOPIC: 2"d Reading of Ordinance No. 17-08, Amending Chapter 503 of the Lino Lakes City Code by changing the definition of a private kennel VOTE REQUIRED: 3/5 BACKGROUND On November 3, 2008, the city council received a request from a Lino Lakes resident to amend the Lino Lakes Animal Ordinance. The current ordinance states that any resident who owns 3 dogs on one acre of land must obtain a private kennel license. Any resident with a lot less than one acre can only own two dogs. The request was to add to the city's animal ordinance a provision to allow foster dogs in addition to the 2 dog limit on a less than 1 acre parcel of land. The council has considered options to address this situation, including: no change to the regulations, a special allowance for fostering, changing the number of dogs allowed, or changing the acreage requirement. The council also reviewed kennel licensing requirements for surrounding cities. At the December 1, 2008 work session, the council directed staff to prepare an amendment to the city code that would increase the number of dogs allowed (without a private kennel license) from two to three. The first reading of Ordinance No. 17-08 that would put an increase into place in the city code was approved on December 8, 2008. Staff is now presenting the ordinance for second reading and approval. If approved, the new regulations would become effective 30 days after publication as dictated by the city charter. RECOMMENDATION Second reading and passage of Ordinance No. 17-08, amending Chapter 503 related to Animal Control, by changing the definition of a private kennel.
