S/ ZoD(o C.(f.cchTan S 2do7 `Pe corder : 19_04 2ouncil MemberO' Donneliboved for adoption of the following ordinance: CITY OF LINO LAKES ORDINANCE NO. 11-06 APPROVING REZONING OF PROPERTY AT 547 LOIS LANE FROM R (RURAL) TO R-1 (SINGLE FAMILY RESIDENTIAL) (GOLDEN ACRE) The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: Section 1: Findings The City Council makes the following findings regarding rezoning the property described below, based on the factors listed in Section 2 of the Lino Lakes zoning ordinance: 1. The R-1 (Single Family Residential) zoning designation will allow single family development in accordance with the Comprehensive Plan designation for the site of Low Density Sewered Residential. 2. The surrounding area is similarly designated for Low Density Sewered Residential. 3. The proposed single family development has been reviewed and found to be conforming to all applicable city standards. 4. The proposed development will be accommodated with existing public services and will not overburden the City's service capacity. Municipal water and sanitary sewer are available to the site and sufficient capacity exists. Traffic generation by proposed uses will be required to be within capabilities of streets serving the property. Section 2 The Zoning Ordinance of the City of Lino Lakes, Anoka County, Minnesota, passed by the City Council on March 10, 2003 is hereby amended by rezoning from R (Rural) to R-1 (Single Family Residential) the following property: Lot 4, Block 1, Mar Don Acres according to the plat of record thereof, Anoka County, Minnesota Section 3 As above amended, said Zoning Ordinance shall stand as initially passed and previously amended. Section 4 This ordinance shall be in force and effect from and after its passage and publication according to the Lino Lakes City Charter. The motion for the adoption of the foregoing ordinance was duly seconded by Council Member Reiner rand upon vote being taken thereon, the following voted in favor thereof: O'Donnell, Reinert, Carlson, Stoltz, Bergeson The following voted against same: none Whereupon said ordinance was declared duly passed and adopted. AGENDA ITEM 6B STAFF ORIGINATOR: Mary Alice Divine DATE: 11/27/06 TOPIC: Second Reading of Ordinance 12-06, Reconveying City owned land to the State of Minnesota Vote Required: Simple Majority BACKGROUND: On August 9, 2004 the city requested that Anoka County withhold from sale a tax forfeited parcel (see attached) so that the city could obtain the parcel for public purposes. The city wanted to retain this parcel for a well, but did not use the parcel for that purpose. An abutting landowner has inquired about purchase of that parcel. In order to make that property available for private purchase, the city must reconvey the land back to the State of Minnesota. Once that is complete the County will notify surrounding landowners and offer it at a private sale. The city charter requires that disposal of any city property shall be done by ordinance. OPTIONS: 1. Approve the Second Reading of Ordinance 12-06 reconveying the parcel back to the State of Minnesota 2. Do not approve the ordinance 3. The real property described as: Outlot F, D Erickson 2nd Addition is owned by the City of Lino Lakes (the "City"). The city council of the City has determined that the Property is no longer needed by the City for any public purpose. II. The city council of the City authorizes reconveyance of the parcel to the State of Minnesota. The mayor and city clerk are hereby authorized and directed to execute any documents as may be necessary in order reconvey the Property in accordance with the requirements of the city charter. This ordinance shall be in full force and effect from and after 30 days following its passage and publication, in accordance with section 3.09 of the city charter.
