HomeMy WebLinkAbout2002-008 Council OrdinancesCITY OF LINO LAKES ORDINANCE NO. 08-02 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF LINO LAKES BY REZONING CERTAIN REAL ESTATE FROM R-1, SINGLE FAMILY RESIDENTIAL TO GB, GENERAL BUSINESS DISTRICT/ PDO, PLANNED DEVELOPMENT OVERLAY The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: SECTION 1. FINDINGS The City Council makes the following findings regarding the application for rezoning the property described below, based on the factors listed in Section 2, Subd.1E of the Lino Lakes zoning ordinance: 1. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan, as the site is guided for commercial uses. The site is guided for commercial land uses and subject to the conditions of site and building plan/conditional use permit approval the development is consistent with the Lino Lakes Comprehensive Plan. 2. The proposed use is or will be compatible with present and future land uses of the area. The site is guided for commercial uses. Land in the area of the site is already developed with commercial uses or designated for such use. Subject to the conditions of site and building plan/conditional use permit approval the site is compatible with existing commercial and residential uses as well as future commercial and residential. 3. The proposed use conforms with all performance standards contained within the city's zoning ordinance. 4. The proposed use can be accommodated with existing public services and will not overburden the City's service capacity. Existing sanitary sewer and water services are available to the site and will not overburden existing public services. 5. Traffic generation by the proposed use is within capabilities of streets serving the property in conjunction with the public improvements proposed. Traffic generation by the proposed use is within the capabilities of the streets directly serving the property in conjunction with the required public improvements. The required public improvements are those designated in the Anoka County letter and attached concept plan dated November 20, 2002. The proposed development will assist with the improvement of the Birch/Hodgson intersection signalization. The Zoning Ordinance of the City of Lino Lakes, Anoka County, Minnesota, passed by the City Council on July 14, 1997 is hereby amended by rezoning from R-1, Single Family Residential to Ordinance 08-02 Page 2 GB, General Business District/ PDO, Planned Development Overlay pursuant to the provisions of the Zoning Ordinance of the City of Lino Lakes, the following described real estate: Outlot A, Spirit Hills SECTION 2. DISTRICT PROVISIONS A. Development of the property shall be subject to City Site and Building Plan approval. Such plans shall be in substantial conformance with the preliminary development plans shown on the following exhibits: Exhibit A Site grading, drainage, and erosion control plat dated 4/11/02 and revised 6/21/02 Exhibit B Site Plan dated 4/11/02 and revised 6/12/02 Exhibit C Utility Plan dated 6/12/02 and revised 7/02/02 Exhibit D Landscaping and tree preservation plan dated 6/12/02 Exhibit E Building Elevations dated 7/10/02 Exhibit F Lighting Plan dated received 3/11/02 SECTION 3. SPECIAL PROVISIONS A. Minor variations from the approved plans may be approved by the City's Development Review Committee, under the direction of the Community Development Director. Substantial departures from the approved plans will require an amendment to the Planned Development Overlay (PDO). B. Unless otherwise specified herein the development shall be subject to the provisions of the Lino Lakes Zoning Ordinance and all other applicable chapters of City Code. SECTION 4. As above amended, said Zoning Ordinance shall stand as initially passed and previously amended. SECTION 5. This ordinance shall be in force and effect from and after its passage and publication according to the Lino Lakes City Charter.
