HomeMy WebLinkAbout2003-010 Council OrdinancesOrdinance No. 10-03 AN ORDINANCE ADOPTING THE MINNESOTA STATE BUILDING CODE. THIS ORDINANCE: PROVIDES FOR THE APPLICATION, ADMINISTRATION, AND ENFORCEMENT OF THE MINNESOTA STATE BUILDING CODE BY REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL, DEMOLITION, CONVERSION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA, AND MAINTENANCE OF ALL BUILDINGS AND/OR STRUCTURES IN THIS MUNICIPALITY; PROVIDES FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREOF; PROVIDES PENALTIES FOR VIOLATION THEREOF; REPEALS ALL ORDINANCES AND PARTS OF ORDINANCES THAT CONFLICT THEREWITH. The City of Lino Lakes city council does ordain the following: Section 1. Application, Administration, and Enforcement. The application, administration, and enforcement of the code shall be in accordance with Minnesota Rule Chapter 1300. The code shall be enforced within the extraterritorial limits permitted by Minnesota Statutes, 16B.62, subdivision 1, when so established by this ordinance. The code enforcement agency of this municipality is called The City of Lino Lakes. This code shall be enforced by the Minnesota Certified Building Official designated by this Municipality to administer the code (Minnesota statute 16B.65) subdivision 1. Section 2. Permits and Fees. The issuance of permits and the collection of fees shall be as authorized in Minnesota Statutes, 16B.62, subdivision 1. Permit fees shall be assessed for work govemed by this code in accordance with the fee schedule adopted by the municipality in Exhibit "A". In Addition, a surcharge fee shall be collected on all permits issued for work govemed by this code in accordance with Minnesota statute 16B.70. Section 3. Violations and Penalties. A violation of this code is a misdemeanor (Minnesota statute 16B.69) and Minnesota Rules, Chapter 1300. Section 4. Building Code. The Minnesota State Building Code, established pursuant to Minnesota Statutes 16B.59 to 16B.75 is hereby adopted as the building code for this Municipality. The code is hereby incorporated in this ordinance as if fully set out herein. A. The Minnesota State Building Code includes the following chapters of Minnesota Rules: 1. 1300, Administration of the Minnesota State Building Code; 2. 1301, Building Official Certification; 3. 1302, State Building Code Construction Approvals; 4. 1303, Minnesota Provisions; 5. 1305, Adoption of the 2000 International Building Code; 6. 1306, Special Fire Protection Systems; 7. 1307, Elevators and Related Devices. 8. 1309, Adoption of the 2000 International Residential Code; 9. 1311, Adoption of the 2000 Guidelines for the Rehabilitation of Existing Buildings; 10. 1315, Adoption of the 2002 National Electrical Code; 11. 1325, Solar Energy Systems; 12. 1330, Fallout Shelters; 13. 1335, Floodproofmg Regulations; 14. 1341, Minnesota Accessibility Code; 15. 1346, Adoption of the Minnesota State Mechanical Code; 16. 1350, Manufactured Homes; 17. 1360, Prefabricated Structures; 18. 1361, Industrialized/Modular Buildings; 19. 1370, Storm Shelters (Manufactured Home Parks); 20. 4715, Minnesota Plumbing Code 21. 7.670, 7672, 7674, 7676 and 7678, Minnesota Energy Code B. The City of Lino Lakes hereby adopts by reference the following optional chapters of Minnesota Rules; Chapter 1306, Special Fire Protection Systems with Option 1306.0020, Subpart 2, and Option 1306.0030, E-1; and Chapter 1335, Floodproofmg Regulations, parts 1335.0600 to 1335.1200. Section 5. Effective Date of Ordinance. This Ordinance shall take effect upon its passage and publication according to the City Charter. Plan Review Fee a. 65% of the Building Permit Fee b. In instances where two (2) or more permits are issued for a residential structure, the plan review fee shall be forty percent (40%) per dwelling unit. 7. Escrow Fees An escrow fee in the amount of $1,500.00 shall be paid before a building permit is issued for all new buildings. The escrow fee shall be returned to the permit applicant, without interest, upon successful completion of the following: a. Sod installation. b. Curb stops must be raised to grade, in good condition and easily operable. Curb stops in driveways will have a driveway cover, available at the Public Works Department, or an approved alternate. Damaged curbing will be replaced as necessary. c. Phone read must be installed. d. All utility bills must be paid by the permit applicant up to the closing of the home. e. As built survey must be submitted and approved by City Engineer. These items need to be completed within six (6) months of the issuance of the certificate of occupancy (weather permitted). If the builder has not called for the escrow inspection by six months, the city will automatically do the inspections. Once the request for an inspection has been made, the city will return the escrow within 30 days after last inspection has passed 8. Easement Encroachment Fee $30.00 9. Fence Permit $30.00 10.
