CITY OF LINO LAKES ORDINANCE NO. 12.01 AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN BY ALLOCATING 11 ACRES OF MUSA RESERVE TO THE WEST SHADOW PONDS DEVELOPMENT The City Council of the City of Lino Lakes, Anoka County, Minnesota does hereby ordain: Section 1. The City Council finds that the proposed project meets the City's Interim MUSA Reserve Criteria as follows: 1. The request for MUSA is occurring concurrently with preliminary plat application. 2. The rezoning request is occurring concurrently with the MUSA request. 3. MUSA is adjacent to the north border of the site. 4. The net acreage for the project is 11 acres, and that is the MUSA request. 5. Utilities exist directly adjacent to the site. 6. West Shadow Lake Drive is planned as a minor collector road. The extension of West Shadow Lake Drive through the site is consistent with the City's transportation plan. 7. The City has reviewed the proposal and determined it will not adversely affect the community health, welfare, or general safety. 8. The City has reviewed the proposal and determined that impacts to the environment are mitigated by the wetland plan approved by the Rice Creek Watershed District. Large wetland areas will be retained, and new replacement wetlands will be created for a net increase in wetlands. 9. The existing City park adjacent to the development was dedicated in part in anticipation of the park dedication requirements of this development. The park location is consistent with the City's Comprehensive Park Plan. 10. The site is within Sewer District No.1 which is consistent with the MUSA reserve agreement with the Metropolitan Council. 11. Utilities exist directly adjacent to the site and extension to this site is consistent with the City's sewer and water plan. 12. The developer has demonstrated a significant commitment to the community by way of previous development projects. 13. The proposed development complies with the City's Infill Policy outlined by Resolution No. 92-85, because: allocation of MUSA reserve will put the site within the MUSA; the development of the site has been analyzed for impacts on utility and street system costs; the analysis determined that costs will be covered, that operation and maintenance will not exceed normal costs, and there will be no additional costs. 14. When improved according to the recommended plans, West Shadow Lake Drive and 62nd St. will be adequate to handle traffic. Section 2. A public hearing was held before the Planning & Zoning Board on November 12, 1998. Section 3. Since the findings support the proposal, 11 acres of interim MUSA reserve shall be allocated to the area included in the West Shadow Ponds development. Section 4. This ordinance shall be in force and effect from and after its passage and publication according to the Lino Lakes City Charter. Passed by the Lino Lakes City Council this 27th day of August Jean Ver, Deputy Clerk , 2001. The motion for adoption of the foregoing ordinance was duly seconded by Council Member Carlson and upon vote being taken thereon, the following voted in favor thereof: Bergeson, Carlson, Dahl, Reinert and O'Donnell The following voted against same: None. Whereupon said ordinance was declared passed and adopted.
