HomeMy WebLinkAboutOrdinance 05-99Council Member Dahl introduced the following ordinance and moved its adoption: CITY OF LINO LAKES COUNTY OF ANOKA ORDINANCE NO. 05-99 AN ORDINANCE VACATING ROADWAY EASEMENTS DESCRIBED IN DOCUMENT NO. 690358 AND NO. 682691 AND 717509 (Clearwater Creek 3rd Addition, plat drawing attached) The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: I. That it is in the best interest of the City and the property owner to vacate the previously recorded roadway easements to make way for the platting of Clearwater Creek 3rd Addition. II. That the legal description of said roadway easement is described as follows: (see insert) III. That the City held a Public Hearing before the City Council continued from March 22, 1999 to April 12, 1999 after due published and posted notice had been given on March 2nd 1999 and March 9th, 1999 and all persons interested were given an opportunity to be heard. IV. This ordinance shall be in force and effect from and after its passage and publication according to the Lino Lakes City Charter. The following voted against same: none. Whereupon said ordinance was declared duly passed and adopted. ATTACHMENT TO Ordinance No., 05-99, City of Lino Lakes 6Subject to road easement to the City of Lino Lakes over the North 40 feet as evidenced by Document No. 680358. r6. Subject to road easement over the South 40 feet as evidenced by Document No. 682691 and subsequent Documents. Subject to a perpetual roadway easement as evidenced by Document No. 717509 to the City of Lino Lakes 80.00 feet in width for public roadway purposes over, under and across the described property: The Northwest Quarter of the Southeast Quarter of Section 25, Township 31, Range 22, Anoka County, Minnesota, and That part of the North 595.00 feet of the Northeast Quarter of the Southwest Quarter of said Section 25, lying east of Interstate Highway No. 35E., The centerline of said perpetual easement being described as follows: Commencing at the Northeast corner of said Northwest Quarter of Southeast Quarter Section 25; thence _.in as assumed bearing of South 0 degrees 43 minutes 11 seconds West along the east line of said Northwest Quarter of Southeast Quarter of Section 25. a distance of 590.08 feet to the point of beginning of the centerline to be described; thence North 89 degrees 16 minutes 49 seconds West 940.00 feet: thence westerly 343.31 feet along a tangential curve concave to the north having a central angle of 27 degrees 23 minutes and a radius of 718.33 feet; thence North 61 degrees 53 minutes 49 seconds West and tangent to last described curve 459.89 feet to the east right-of-way line of said Interstate Highway No. 35E., and there terminating. Together with a perpetual easement 60.00 feet in width for public roadway purposes over, under and across the above described property.
