HomeMy WebLinkAbout1997-011 Council OrdinancesCouncil Member Neal adoption: introduced the following ordinance and moved its CITY OF LINO LAKES ORDINANCE NO. 11 - 97 AN EMERGENCY ORDINANCE AMENDING CHAPTER 403, INDIVIDUAL SEWAGE TREATMENT SYSTEMS CHAPTER 70-80, MINNESOTA POLLUTION CONTROL AGENCY WATER QUALITY DIVISION, INDIVIDUAL SEWAGE TREATMENT SYSTEMS, VARIANCES. The City Council of the City of Lino Lakes ordains that the Lino Lakes City Code is amended by adding a chapter to read as follows: SECTION 1. DECLARATION OF NEED FOR EMERGENCY ORDINANCE Due to conditions existing on properties in need of septic repair wherein a further delay in undertaking of repairs caused by the variance application process could result in harm to the public peace, safety and health, as necessary to provide for an administrative variance in certain limited circumstances. SECTION 2. Section 403.03 Permits, Subd. 4, Variances, is hereby added to Chapter 403 as follows: Subdivision 4. Variances. Where conditions prevent the construction, alteration, and/or repair of a water well or an individual sewage treatment system, on an existing developed parcel of real property, the building official may reduce the property line and building setbacks in system sizing requirements providing said reduction does not endanger or unreasonably infringe on adjacent properties and with the concurrence of the effected properties. SECTION 3, EFFECTIVE DATE. The effective date of the amended ordinance shall be June 9, 1997 and publication according to the City Charter. The following voted against same: None, Council Member Kuether was absent. Whereupon said ordinance was duly passed and adopted.
