HomeMy WebLinkAbout1984-014 Council Ordinances• • • CITY OF LINO LAKES COUNTY OF ANOKA STATE OF MINNESOTA Ordinance No. 14 - 84 AN ORDINANCE AMENDING ORDINANCE NO. 2 OF THE CITY OF LINO LAKES, BY CHANGING CERTAIN REQUIREMENTS FOR ACCESSORY BUILDINGS. The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: Ordinance No. 2 of the City of Lino Lakes, Anoka County, Minnesota passed by the City Council on May 24, 1983 is hereby amended by changing certain requirements for accessory buildings pursuant to the provisions of the Zoning Ordinance of the City of Lino Lakes: I. AMENDMENT. Section 4, Subd. 7 of the Lino Lakes Ordinance No. 2 is hereby amended to read as follows: Subd. 7. Accessory Buildings and Structures. (1) Types of Accessory Buildings. Storage or tool sheds; detached garage; detached rural storage building; detached domesticated farm animal building. Said accessory buildings are defined as follows: (A) Storage or Tool Shed. A small one-story accessory building used or intended for the storage of hobby tools and garden equipment. (B) Detached Garage. A one-story accessory building used or intended for the storage or motor driven passenger vehicles. (C) Rural Storage Building. A one-story accessory building used or intended for the storage of hobby tools, garden equipment, workshop equipment, boats, snowmobiles, etc. (D) Detached Domesticated Farm Animal Building. A one-story accessory building used or intended for the shelter of domestic farm animals and/or related feed or other farm animal supportive materials. Said building shall require a Minnesota Pollution Control Agency Feedlot Permit. (2) No accessory building or use shall be constructed or developed on a lot prior to the time of construction of the principal building to which it is accessory. (3) Accessory building shall be considered as an integral part of the principal building if it is located less than six (6) feet from the principal building. (4) Houseboats are to be considered accessory structures for purposes of applying this Ordinance. Any object that floats which has sleeping accommodations and facilities for preparing food shall be defined as a houseboat. All houseboats which are to be docked or moored within the City limits for a period of six (6) days or more shall require an annual Conditional Use Permit. Said permit shall show the owner, owner's address, boat licence number, whether the boat is to be used as a seasonal residence and, if so, for what period of time during the year, type of sanitary sewage facility, water supply, and plot plan showing method of access to public road. Each houseboat shall have one off-street parking space within four hundred (400) feet of the access to the docking of such houseboat. No houseboat shall be used as a permanent residence and, further, that utilities including sanitary sewer, water, electricity, and phone shall not be extended to the houseboat. (5) Ice fishing houses stored on parcels of land during summer months shall be considered an accessory building. (6) Accessory buildings in the ER, R1 or greater Residential districts must be set back at least ten (10) feet from the side lot line and ten (10) feet from the rear lot line. Tool sheds - five (5) foot set back at side and rear. (7) Accessory buildings in the "Business" and "Industry" dis- tricts shall not be closer than ten (10) feet from side and rear lot lines subject to provisions for abutting resi- dential zone. (8) No accessory building in a commercial or industrial district shall exceed the height of the principal building except by Conditional Use Permit. (9) A private garage in an ER, R1 or greater residential district shall not be utilized for business service or industry. Fur- ther, that not more than one-half of the space may be rented for the private vehicles of persons not resident on the pre- mises. Such garage shall not be used for more than one commercial vehicle. The gross weight of such vehicle shall not exceed 11,075 pounds gross weight. (10) Roadside Stands. Seasonal, temporary roadside stands for the sale of agricultural products shall be permitted if: 1) they are erected at least 60 feet back from the nearest edge of the roadway surface, 2) they are used exclusively for the sale of agricultural products grown in the City of Lino Lakes, and 3) adequate parking space is provided off the road right-of-way and safe vehicular access and movements are assured. 11 Total Number and Specifications of Accessory Buildings Per- mitted Residential Districts. The following summarizes the maximum number of accessory buildings allowed in an in- dividual parcel according to lot size and residential dis- trict. (A) 20 acres or greater (R & ER District) No requirement. - Pole barns acceptable. No maximum height re- - quirement. (B) 10 to less than 20 acres - 1 Tool shed (maximum (R & ER District) 400 sq. ft.). - 1 Detached garage (max- 111 imum 760 sq. ft.). - 1 Storage building or domesticated farm animal building (maximum 2400 sq. ft.). - Pole barns acceptable. - No maximum height re- quirement. (C) 5 to less than 10 acres (R & ER District) (D) 2J to less than 5 acres (R & ER Districts) • (E) 1 to less than 2?I _acres (R, ER _& Other Residential Districts) • - 1 Tool shed (maximum 400 sq. ft.). - 1 Detached garage (max- imum 760 sq. ft.). - 1 Storage Building or domesticated farm animal building (maximum 1600 sq. ft.). - Pole barns acceptable. - No maximum height re- quirement. - 1 Tool shed (maximum 400 sq. ft.) - manu- factured metal structure optional. - 1 Detached garage (max- imum 760 sq. ft.), if there is no attached garage. - 1 Storage building or domesticated farm animal building (maximum 1000 sq. ft.) - No metal corrugated sid- ing or roof. - 16 ft. maximum height. - Roof and exterior color & material compatible with home (except manu- factured metal tool shed). 1 Tool shed (maximum 120 sq. ft.) - manu- factured metal structure optional. 1 Detached garage (max- imum 760 sq. ft.), if there is no attached garage. 1 Storage building (max- imum 800 sq. ft.). 16 ft. maximum height. No metal corrugated siding or roof. 1 • (F) Under 11,250 sq. ft. to less 'than 1 acre (R, ER & Other Residential Districts) - Roof and exterior color & material compatible with home (except manu- factured metal tool shed). - 1 Tool shed (maximum 120 sq. ft.) - manufactured metal structure optional. - 1 Detached garage if there is no attached garage (maximum 760 sq. ft.). - No metal corrugated siding or roof. - 14 ft. maximum height. - Roof and exterior color & material compatible with home (except manu- factured metal tool shed). No storage buildings or, detached garages in D, E, or F will be higher than house. II. Save as above amended, said Ordinance No. 2 shall stand as initially passed and as previously amended. • This Ordinance shall be in full force and effect from and after its passage and publication according to the City Charter. Anderson, Deputy Clerk • ORDINANCE NO. AN ORDINANCE AMENDING THE LINO LAKES CITY CODE BY ADDING A SECTION REQUIRING TRAINING FOR PLANNING AND ZONING COMMISSION MEMBERS. The City Council of Lino Lakes ordains: 212.06 Training. Each Planning and Zoning Commission member, within one year of his/her appointment to the Planning and Zoning Commission, shall participate in a total of six (6) hours of traing in the area of land use planning through participation in one or more of the following types of learning experiences: a. vocational school or college courses b. professional conferences or seminars c. attendance at lectures by persons with expertise in land use planning d. such other methods of study as the City Council approves Provided, however, that the City Council, upon request of any newly appointed member made within sixty (60) days of his/her appointment, may waive this training requirement as to that member on the basis that his prior education, employment, or public service background renders further training unnecessary. The City will pay course registration fees and associated costs. Failure to either obtain a waiver or to satisfy the training requirement within the time periods allowed shall constitute cause for removal pursuant to the City Code #212.03. Effective Date.
