CITY OF LINO LAKES
RESOLUTION NO. 03-149
DECLARING COST TO BE ASSESSED, AND ORDERING PREPARATION OF
PROPOSED ASSESSMENT
21ST AVENUE STREET & STROM SEWER IMPROVEMENT PROJECT
WHEREAS, bids have been received for the improvement of 21st Avenue from Main
Street south 675 feet for street reconstruction, and storm sewer improvements; and the
bid price for such improvements is $228,821.90, and the expenses incurred or to be
incurred in the making of such improvement amount to $131,178.10 so that the cost of
the improvement will be $360,000.00.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF LINO LAKES,
MINNESOTA:
1. The portion of the cost of such improvement to be paid by the City of Lino Lakes
is hereby declared to be zero and by the City of Centerville is hereby declared to
be $120,000.00 and the portion of the cost to be assessed against benefited
property owners is declared to be $240,000.00 as per the Joint Powers Agreement
between the two cities.
2. Assessments shall be payable in equal annual installments extending over a period
of 15 years, the first of the installments to be payable on or before May 15, 2004,
and shall bear interest at the rate of 7 percent per annum from the date of the
adoption of the assessment resolution.
3. The city clerk, with the assistance of the city engineer, shall forthwith calculate
the proper amount to be specially assessed for such improvement against every
assessable lot, piece or parcel of land within the district affected, without regard
to cash valuation, as provided by law, and she shall file a copy of such proposed
assessment in her office for public inspection.
4. The clerk shall upon the completion of such proposed assessment, notify the
council thereof.

TOPIC: Resolution No. 03-149, Declaring Cost to be Assessed,
21St Avenue Street & Storm Sewer Improvement Project
VOTE REQUIRED: 3/5 Vote Required
BACKGROUND:
A Public Hearing for the 21' Avenue Street & Storm Sewer Improvement project
was held on August 12, 2002. Following the public hearing, city staff held a
meeting with the City of Centerville and reviewed the Joint Powers Agreement
and the proposed improvements. The City Council authorized the preparation of
plans and specifications and on September 9, 2002. The bids were received on
August 29, 2003 and are within the project budget.
The next step in the process is to declare the costs to be assessed. The total
amount to be assessed is $360,000.00
OPTIONS:
1. Adopt Resolution 03-149, Declaring Cost to be Assessed, 21' Avenue Street
& Storm Sewer Improvement Project.
2. Not Adopt Resolution No. 03-149.
3. Return to staff for further review.
RECOMMENDATION:
Option No. 1 - Staff recommends that Resolution No. 03-149 be adopted.
