HomeMy WebLinkAbout2003-215 Council Resolution• • CITY OF LINO LAKES RESOLUTION NO. 03-215 APPROVING TRANSFER OF EXISTING ON SALE LIQUOR LICENSE FROM DAVID NATHE TO MICHAEL LOVICK, DAMON LAWSON, AND CHRIS MCALPINE D/B/A DM HOSPITALITY AND ISSUANCE OF NEW TOBACCO LICENSE, BOTH FOR THE 49 CLUB, 6007 HODGSON ROAD WHEREAS, the City Council of the City of Lino Lakes met at its regularly scheduled meeting on November 24, 2003, and; WHEREAS, the Lino Lakes City Council discussed transfer of an existing On -Sale Liquor License for the 49 Club located at 6007 Hodgson Road and; WHEREAS, the Lino Lakes City Council discussed issuance of a new tobacco license for the new owners of J & K Liquors which will be Michael Lovick, Damon Lawson, and Chris McAlpine, d/b/a DM Hospitality, and; WHEREAS, the City of Lino Lakes has conducted an investigation of the applicant, and; WHEREAS, the existing establishment, as well as the new applicant are both in compliance with City Ordinance, and; WHEREAS, the applicant has provided proof of insurance as required and paid the necessary fees; NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Lino Lakes hereby approves the tranfer of an existing On -Sale liquor license for the 49 Club, and the issuance of a new tobacco license subject to all the fees, provisions and conditions of the laws of the city, state and of the federal government. Blair, City Clerk November 24, 2003 Consider Adoption of Resolution No. 03-215, Authorizing Transfer of On -Sale Liquor License and Issuance of New Tobacco License for The 49 Club Simple Majority An application has been submitted by Michael Lovick, Damon Lawson, and Chris McAlpine d/b/a DM Hospitality or transfer of an existing On -Sale Liquor License for the 49 Club, 6007 Hodgson Road, from the present owner, David Nathe. The application is complete, and the necessary fees have been paid. The application has also been submitted for a tobacco license for the new owner at this location, in conjunction with this request. The Lino Lakes Police Department has conducted a background investigation relative to these applications as required and found no problems nor any reason to deny the application. In accordance with the City Code Section 701, Liquor Licensing, this business requires City approval for transfer of an existing On -Sale Liquor License, and this business qualifies for such transfer of existing license. In addition, in accordance with the City Code Section 602, Regulating the Sale, Possession and use of Tobacco Products and Tobacco Related Devices, this business requires a Tobacco License from the City of Lino Lakes to engage in sales of any tobacco products, and this business qualifies for such Tobacco License. The applicant is fully aware license approval is subject to all the provisions and conditions of the laws of the city, state and of the federal government. OPTIONS: 1.
