ADJOURN Meeting guidelines on reverse side. City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4-minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice -Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. Occasionally, the Board may continue a hearing to another meeting before taking action. Meeting Etiquette The Planning & Zoning Board must preserve order and decorum while the meeting is in session. ACTION ITEMS A. PUBLIC HEARING to consider rezoning certain properties along Lake Drive from R-1, Single Family Residential and R-1X, Single Family Executive Residential to R, Rural Katie Larsen, City Planner, apologized for the video difficulties. In the absence of the video technician, city staff was unable to record the meeting. If anyone has any questions about the meeting, please contact Ms. Larsen. Ms. Larsen presented the staff report. Staff recommends approval of the rezoning. Chair Tralle questioned how a church was going to be built on this site. Ms. Larsen clarified that it was an allowed use and explained the regulation. Prompted by Mr. Laden, Ms. Larsen discussed the differences between farm animal regulations and housing regulations between R, Rural and R-1X, Single Family Executive Residential. Mr. Masonick wondered if there is going to be a trend of allowing small lot sizes in a Rural zone. Ms. Larsen discussed that this area probably should have been zoned Rural all along and to keep in mind that the lack of utilities are consistent with Rural zones. Mr. Evenson asked if the seaplane base will be rezoned once it is hooked up to City utilities, in which Ms. Larsen replied that it will remain in a Rural zone even if utilities become available. He also requested clarification on the calculation of animal units and Ms. Larsen was able to explain how animal units are determined. Mr. Hyden and Mr. Masonick had questions about hooking up to City utilities when houses are sold and payment of assessment fees, which Mr. Larsen clarified. Mr. Root voiced that he finds the rezoning to be an acceptable solution, as it gets rid of spot zoning, cleans up the airport properties, and removes non-conformance. Mr. Hyden expressed that he does not want to see the seaplane base go away and that he appreciates how unique the airport is. Chair Tralle declared the Public Hearing open at 7:15 p.m. Bruce Hanson, 6980 Lake Drive, is the owner of the seaplane base and wanted to point out that the property will always remain an airport property. Kennedy Stanek, 6970 Lake Drive, discussed her involvement with 4H. Linda Jensen, 6974 Lake Drive, thanked city staff for the rezoning. Ms. Jensen is pleased with the outcome and is glad to be working with the city. The material excavated from the borrow pit will be used for fill in Century Farm North 61h Addition. The following staff report is based on the plan set prepared by Plowe Engineering, Inc. dated July 10, 2015 and received by the City on July 9, 2015. ANALYSIS The 2 parcels are approximately 9.7 acres and located east of Sunset Avenue/CR 53. The disturbed area is approximately 1.1 acres and approximately 9,500 cubic yards (950 loads) of granular material is anticipated to be excavated out of the borrow pit. Approximately 3-4 truck trips per hour are expected during hours of operation. Maximum depth of the borrow pit will be 14 feet with 4:1 and 3:1 slopes and a 10 foot wide safety bench. Excavation will run concurrently with the grading and fill needed for Century Farm North 6th Addition and is anticipated to operate for 3-6 weeks starting late September. The grading shall be in compliance with the approved grading plan for Century Farm North 6th Addition. The borrow pit will remain open and seeded similar to a stormwater pond. Future development of the Morell parcels may require filling in the borrow pit if the area is to be dedicated to the City for additional parkland. Access Material between the borrow pit and Century Farm North 6th Addition will be transported across undeveloped city park property. A temporary access easement will be required. Equipment and vehicles shall not use the improved section of Robinson Drive for access to the borrow pit. The hauling, dumping and grading of excavated materials shall occur within the boundaries of Century Farm North 6th Addition. Materials are not to be exported outside these boundaries. Truck traffic would not access CR 53 except for mobilization, refueling and maintenance. Wetlands Wetlands are shown on the plan sheet and do not appear to be impacted by the borrow pit. Per RCWD CAPROC #15-018 dated March 11, 2015, a wetland delineation was completed onsite in 2013 by Wenck Associates and runs along the western, northern, and southwestern border of the borrow pit site. The estimated wetland boundary is shown to be sufficiently distant from the proposed areas of disturbance; further, the proposed project will not impact any wetlands. Public Ditch Public ditch ACD 10-22-32 bisects the property north to south and the borrow pit is to the east of the ditch. RCWD CAPROC #15-018 dated March 11, 2015 requires the extent of the project in the borrow area include a 16.5 foot setback from the adjacent ditch bank. Floodplain The current 1982 FEMA FIRM does not indicate floodplain in the area. RCWD CAPROC #15-018 dated March 11, 2015 states no floodplain impacts are proposed on site. Grading and Drainage A Grading, Drainage & Erosion Control plan was submitted and has been reviewed by the City Engineer and Environmental Coordinator. Please see attached comments. Comprehensive Plan and Zoning The parcels are guided for medium density residential development and are currently zoned R, Rural. Section 1007.050, Earth Moving and Land Reclamation states earth removal shall be permitted in all zoning districts and establishes conditions that must be met. Tree Preservation Plan A tree preservation plan is not required. There are no significant trees within the excavation area. The proposed development application has been found to be consistent with the policies and recommendations of the Lino Lakes Comprehensive Plan including: a. Land Use Plan. b. Transportation Plan. c. Utility (Sewer and Water) Plans. d. Local Water Management Plan. e. Capital Improvement Plan. f. Policy Plan. g. Natural Environment Plan. The proposed earth moving/borrow pit excavation is consistent with the Comprehensive Plan. The grading plan and earth moving operation have been reviewed by City staff and RCWD. The excavation is temporary and will not have a negative impact on land use, transportation, utilities or the environment. 2. The proposed development application is compatible with present and future land uses of the area. The proposed earth moving/borrow pit excavation is compatible with present and future land uses of the area. The excavation is temporary. Present land use is rural and vacant rural with a single family home. Future land use is medium density residential. Earth moving is allowed in all zoning districts with conditions. 3. The proposed development application conforms to performance standards herein and other applicable City Codes. The proposed earth moving/borrow pit excavation conforms to the performance standards of the City Code with conditions as established. The plans have been reviewed by City staff and RCWD. 4. Traffic generated by a proposed development application is within the capabilities of the City when: a. If the existing level of service (LOS) outside of the proposed subdivision is A or B, traffic generated by a proposed subdivision will not degrade the level of service more than one grade. b. If the existing LOS outside of the proposed subdivision is C, traffic generated by a proposed subdivision will not degrade the level of service below C. al c. If the existing LOS outside of the proposed subdivision is D, traffic generated by a proposed subdivision will not degrade the level of service below D. d. The existing LOS must be D or better for all streets and intersections providing access to the subdivision. If the existing level of service is E or F, the subdivision developer must provide, as part of the proposed project, improvements needed to ensure a level of service D or better. e. Existing roads and intersections providing access to the subdivision must have the structural capacity to accommodate projected traffic from the proposed subdivision or the developer will pay to correct any structural deficiencies. f. The traffic generated from a proposed subdivision shall not require City street improvements that are inconsistent with the Lino Lakes Capital Improvement Plan. However, the City may, at its discretion, consider developer -financed improvements to correct any street deficiencies. g. The LOS requirements in paragraphs 1. to 4. above do not apply to the I- 35W/Lake Drive or I-35E/Main St. interchanges. At City discretion, interchange impacts must be evaluated in conjunction with Anoka County and the Minnesota Dept. of Transportation, and a plan must be prepared to determine improvements needed to resolve deficiencies. This plan must determine traffic generated by the subdivision project, how this traffic contributes to the total traffic, and the time frame of the improvements. The plan also must examine financing options, including project contribution and cost sharing among other jurisdictions and other properties, that contribute to traffic at the interchange. h. The City does not relinquish any rights of local determination. Traffic generated by excavation of the borrow pit will be temporary and is within the capabilities of the City. Material transport between the borrow pit and fill location (Century Farm North 6th Addition) will be across undeveloped city park property. A temporary access easement will be required. Equipment and vehicles shall not use the improved section of Robinson Drive for access to the borrow pit. The proposed earth moving/borrow pit excavation does not require service by a water supply. 5 6. The proposed development shall not result in the premature expenditures of City funds on capital improvements necessary to accommodate the proposed development. The proposed earth moving/borrow pit excavation shall not expend City funds. 8. The proposed development will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. The proposed earth moving/borrow pit will not be detrimental to any persons or property. Hours of operation, noise and erosion/dust control measures will be enforced. 9. The proposed development will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. The proposed earth moving/borrow pit will not result in the destruction, loss or damage of natural, scenic or historic features. The existing wetlands and public ditch system will not be affected by the activities. No scenic or historic features exist in the area. In addition to the criteria established under Section 1007.016, Conditional Use Permits, Section 1007.050, Earth Moving and Land Reclamation establishes the following conditions that shall be met: (a) Properly fence any pit or excavation, and barricade entrances to prevent the general public from depositing garbage or refuse. (b) Slope the banks, and otherwise guard and keep any pit or excavation in such condition as not to be dangerous because of sliding or caving banks. (c) Properly drain, fill, or level off any pit or excavation so as to make the same safe and healthful as the permitting authority may determine. (d) Limit the depth of such excavation to an elevation no lower than the minimum floor elevation for building construction as established by the City Engineer, so as not to diminish development potential of the parcel. Con (e) Limit any fill material to clean fill, defined as rock, sand, gravel, clay, or other like and similar non -decomposable material. Concrete, asphalt, metal, wood, and other debris shall be prohibited. (f) Require that all decomposable material, or other unsuitable foundation material, be removed from an area before deposition of fill begins. (g) Prepare a site plan showing existing and proposed grade elevations and effect of storm water drainage on adjacent areas. (h) Specify a time when the excavation or land reclamation project shall be completed. (i) Place a minimum of four (4) inches of top soil over the completed project and establish appropriate ground cover within sixty (60) days of completion, or in a time period consistent with the City's stormwater management and pollution prevention plan. 0) Reimburse the City for the cost of periodic inspections by the City for the purpose of determining that the terms under which the permit has been issued are being complied with. (k) Implement the tree preservation plan. (Not applicable) (1) In addition to a conditional use permit, the City Engineer may determine that permits in excess of twenty-five thousand (25,000) cubic yards require the applicant to conduct a neighborhood meeting and to notify affected property owners within one - quarter (1/4) mile. (Not applicable) (m) Post a form of security and sum as the permitted authority may require, running to the City, conditioned to pay the City the cost and expense of repairing or cleaning any highways, streets, or other public ways within the City made necessary by the special burden resulting from transporting thereon by the applicant material to or from the site, the amount of such cost to be determined by the Council; and conditioned further to comply with all the requirements of this Ordinance and the particular permit, and to save the City free and harmless from all suits or claims for damages resulting from the negligent excavation, removal, storage, or filling of rock, sand, dirt, gravel, clay, or other like material within the City. (n) Other conditions deemed appropriate to the application by the permitting authority. Environmental Board The Environmental Coordinator and Board will review and comment on the proposal at their August 26, 2015 meeting. 7 Development Agreement for Grading A Development Agreement for Grading incorporating both the earth moving/borrow pit excavation and Century Farm 6th Addition grading shall be drafted by the City, executed by the City and the developer and recorded by the developer. A grading permit and securities shall be deposited by the applicant. RECOMMENDATION Staff recommends approval of the conditional use permit for earth moving/borrow pit excavation subject to the following conditions: 1. All comments from the City Engineer letter dated August 4, 2015 shall be addressed. 2. A Temporary Access Easement shall be drafted by the applicant and submitted to the City for review and recording. 3. A Development Agreement shall be drafted by the City and executed by both parties and recorded. 4. Soil borings for the borrow pit area shall be submitted. 5. Traffic Generation: a. Equipment and vehicles shall not use the improved section of Robinson Drive for access to the borrow pit. b. The hauling, dumping and grading of excavated materials shall occur within the boundaries of Century Farm North 6th Addition. c. Materials shall not be exported outside these boundaries. d. This review is based on the NorthPointe 3rd Addition street and utility plan set and final plat dated June 22, 2015 and prepared by Carlson McCain. Previous Council Actions: • March 10, 2014: NorthPointe PUD Development Stage Plan/Preliminary Plat, Resolution No. 14-21 • June 23, 2014: NorthPointe PUD Final Plan -Final Plat, Resolution No. 14-47 • September 22, 2014: NorthPointe 2nd Addition, Resolution No. 14-105 ANALYSIS Subdivision Ordinance Conformity with the Comprehensive Plan and Zoning Code The final plat has been reviewed for compliance with the comprehensive plan, zoning and subdivision ordinance. The proposed development is not considered premature and meets the performance standards of the subdivision and zoning ordinance. The final plat is consistent with the PUD Development Stage Plan/Preliminary Plat and Final Plan. There is a modification from the phasing plan. The original phasing plan for Phase III was for 92 lots and included dedication of the parkland. The parkland will now be dedicated in Phase IV. The phasing plan shall be revised accordingly. Blocks and Lots The final plat for NorthPointe 3rd Addition creates 41 lots and 2 outlots. Outlots A and B are for future development, parkland, stormwater management and wetland protection areas. Drainage and utility easements were previously dedicated over the stormwater management areas on Outlot D, NorthPointe. A Conservation Easement was also dedicated to RCWD over the wetland and buffer areas on Outlot D, NorthPointe. Public Land Dedication and Fees The City will require a combination of land dedication and cash in lieu of land for the entire NorthPointe development. NorthPointe 3rd Addition varies from the original phasing plan and the parkland will now be dedicated with Phase IV (anticipated 2016). So, Phases I, II, III, V and Outlot B (age -restricted multi -family complex) will pay straight park dedication fees per unit at the time of each final plat. Phase IV will dedicate 5.04 acres of parkland, credit trail construction costs and collect or credit any remaining cash balance associated with Phase IV. NorthPointe 3rd Addition 1! 7 41 lots x $2,500 = $102,500 Zoning NorthPointe 3rd Addition is zoned PUD-Planned Unit Development as approved by the City Council with Ordinance No. 02-14. Comprehensive Plan The final plat is in compliance with the Comprehensive Plan in terms of the Resource Management System, Land Use Plan, Housing Plan, and Transportation Plan. Alternative Urban Areawide Review (AUAR) The project site is within the 2005 I-35E Corridor AUAR and is subject to the AUAR mitigation plan. The NorthPointe PUD Development Stage Plan/Preliminary Plat is consistent with development Scenario 1 for residential medium density and complies with the mitigation plan in regards to wetlands, water use, erosion and sedimentation, surface water runoff, wastewater and transportation. The final plat for NorthPointe 3rd Addition is also consistent with these plans. Floodplain The current 1982 FEMA FIRM indicates Zone A floodplain potentially affecting Lots 4- 6, Block 4, NorthPointe 3rd Addition. The applicant has applied for and received a Conditional Letter of Map Amendment; however, a Letter of Map Revision shall be required by the City prior to any building permits being issued on these lots. Development Agreement A Development Agreement shall be drafted by the City, executed by the City and the developer and recorded by the developer. Title Commitment The City Attorney reviewed the title commitment and final plat and notes the commitment must be updated and consent of the mortgages shall be obtained. Stormwater Maintenance Agreement A Maintenance Agreement for Stormwater Management Facilities was approved by the City Council on August 11, 2014 with Resolution No. 14-87 for the entire NorthPointe development. RECOMMENDATION Staff recommends approval of the NorthPointe 3rd Addition final plat subject to the following conditions: 1.
