RESOLUTION NO. 01-90
A RESOLUTION AUTHORIZING CONDEMNATION AT 6993 BLACK DUCK DRIVE
AND 6998 BLACK DUCK DRIVE FOR PUBLIC TRAIL
WHEREAS, the City of Lino Lakes wishes to construct a public trail at the end of Black Duck
Drive for the enjoyment of area residents; and
WHEREAS, the property owners at 6993 Black Duck Drive and 6998 Black Duck Drive have
agreed to sell a portion of their property for this public trail; and
WHEREAS, the property owners are requesting the City to initiate a "friendly" condemnation
process to acquire the land described in the purchase agreements.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lino Lakes, the
Council directs the City Attorney to begin condemnation proceedings to acquire approximately
3,035 square feet of property located at 6993 Black Duck Drive and 6998 Black Duck Drive.
Adopted by the Lino Lakes City Council this 9th day of July, 2001.

The motion for the adoption of the foregoing resolution was duly seconded by Council Member
Dahl and upon vote being taken thereon, the following voted in favor thereof:
Bergeson, Carlson, Dahl, Reinert and O'Donnell

Whereupon said resolution was declared duly passed and adopted.

TOPIC: Consideration of Resolution 01-90, Authorizing
Condemnation at 6993 & 6998 Black Duck Drive For
Public Trail
VOTE REQUIRED: Simple Majority
BACKGROUND:
For the past several years, the City of Lino Lakes has been attempting to place a public
trail at the north end of Reshanau Lake. At the April 9, 2001 City Council meeting, the
City Council approved the purchase agreements to acquire the necessary land located
at 6993 Black Duck Drive and 6998 Black Duck Drive.
In June, 2001 staff was informed by one of the property owners that the mortgage
lenders of his property require a complex, time consuming, and expensive process to
authorize the sale of the land to the City. Subsequently, both property owners are
requesting the City initiate a "friendly" condemnation process to acquire the land
described in the purchase agreements.
Therefore, staff is recommending the City Council direct the city attorney to begin
condemnation proceedings to acquire the necessary land at 6993 Black Duck Drive and
6998 Black Duck Drive as previously agreed with the property owners. All components
of the purchase agreements will remain in effect.
OPTIONS:
1. Approve Resolution 01-90.
2. Do not approve Resolution 01-90.
3. Return to staff for further review.
