Council Member Dahl introduced the following resolution and moved its
adoption.
CITY OF LINO LAKES
RESOLUTION NO. 01-94
RESOLUTION APPROVING THE FINAL PLAT FOR
BEHM'S FARM PARK ADDITION
WHEREAS, a request has been submitted to the City for the approval of a final plat, and
WHEREAS, review and approvals of plats are governed by state statutes and City
ordinances, and
WHEREAS, the preliminary plat for Behm's Farm Park Addition was approved with
Resolution 01-06 by the City Council on May 29, 2001, and
WHEREAS, the final plat for Behm's Farm Park Addition received by the City complies
with City requirements, and
WHEREAS, Resolution 01-06 included conditions of approval which require that
Ordinance 01-01 and Ordinance 02-01 be in effect before the final plat is recorded and
these ordinances will become effective July 18, 2001,
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lino
Lakes hereby approves the final plat for Behm's Farm Park Addition.
BE IT FURTHER RESOLVED that the City will not release the signed plat for recording
prior to July 18, 2001.

Behm's Farm Park Addition
ACTION REQUIRED: 3/5 vote
BACKGROUND
The City Council approved the preliminary plat for Behm's Farm Park Addition on May
29, 2001. We have received a request for approval of the final plat.
The City typically requires a number of things for a final plat approval. These include:
• Final plat must substantially conform to the approved preliminary plat.
• Development agreement must be completed, including financial securities.
• Title must be reviewed by City Attorney.
• Conditions of approval must be met.
The final plat conforms to the preliminary plat. No development agreement is necessary,
as all roads and utilities exist. The City Attorney has confirmed that no title work is
necessary for the plat approval because the City owns the property and will be selling it
to the developer.
The conditions of approval for the preliminary plat are as follows:
1. Ordinance 01-01 must be in effect (30 days after publication) before the final plat
can be recorded.
2. Ordinance 02-01 must be in effect (30 days after publication) before the final plat
can be recorded.
3. The developer must notify purchasers of residential lots of the existence of the
nearby Lino Air Park. The developer must provide to the City a copy of the
notification format to be used before final plat approval by the City.
The two ordinances were published June 18. They will be in effect July 18. The closing
(when the City will sell the land to the developer) has been arranged for July 20. The
City will not release the signed plat hardshells for recording until July 18. This
requirement is included in Resolution 01-94 approving the final plat.
The developer has provided a copy of the disclosure statement. It notifies buyers that
"typical aircraft operations may result in perceptible noise and light effect" within the
development area.
OPTIONS
1. Approve Resolution 01-94 approving the final plat of Behm's Farm Park Addition.
2. Return to staff with direction.
