CITY OF LINO LAKES RESOLUTION NO. 01-107 RESOLUTION APPROVING THE PRELIMINARY PLAT AND PRELIMINARY DEVELOPMENT PLAN FOR LINO LAKES MARKETPLACE WHEREAS, the City has received an application for preliminary plat/preliminary development plan approval for Lino Lakes Marketplace, and WHEREAS, A public hearing was opened before the Planning & Zoning Board for the preliminary plat and rezoning on February 13, 2001 and was closed July 11, 2001, and WHEREAS, Ordinance 16-01 rezones the subject property to Planned Development Overlay District, and WHEREAS, the preliminary plat and preliminary development plan are in conformance with the requirements of Section 9. Subdivision 3 of the zoning ordinance related to Planned Development Overlay Districts, NOW, THEREFORE, BE IT RESOLVED that the City Council of Lino Lakes hereby approves the preliminary plat, for Lino Lakes Marketplace prepared by Westwood Professional Services, Inc., dated 8/8/01, received by the city of Lino Lakes on 8/8/01 and the preliminary development plan, for Lino Lakes Marketplace prepared by Parsons Transportation Group, Inc., dated 7/30/01, and received by the City of Lino Lakes on 7/31/01. BE IT FURTHER RESOLVED that the approval is subject to the following conditions: 1. Approval of the Planned Development Overlay Rezoning (Ordinance 16-01). 2. The Preliminary Development Plan be revised as follows: a. Eliminate the 36 parking stalls shown as "Proof of Parking" on the north side of the Kohl's (Lot 8) parking lot. b. Include concrete pavement treatment for crosswalks. c. Modify lighting levels along the north side of Lot 8 to meet ordinance requirements of 0.4 foot candles at property line. d. Remove the single user monument sign from Outlot D. 3. Final Plat shall provide language dedicating Outlot C to the City of Lino Lakes. 4. Development of Outlot D and Outlot E as depicted in the Development Plan shall be contingent on the developer acquiring title to the adjacent parcel and subsequent subdivision and site plan approvals. 5. Final grading, drainage and utility plans shall be reviewed and approved by the City Engineer. 6. All required permits shall be obtained by from the Rice Creek Watershed District prior to the commencement of site grading activities. 7. Permits from all other county, state, and federal authorities shall be obtained prior to final plat approval. Adopted by the Lino Lakes City Council thi 3day of August, 2001 o n J. Whereupon said resolution was declared passed and adopted.
