City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4-minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice -Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. Occasionally, the Board may continue a hearing to another meeting before taking action. Meeting Etiquette The Planning & Zoning Board must preserve order and decorum while the meeting is in session. ACTION ITEMS A. PUBLIC HEARING to consider Conditional Use Permit — Morell Earth Movin2/11orrow Pit Excavation at 7860 Sunset Avenue Katie Larsen, City Planner, presented the staff report. Staff recommends approval of the conditional use permit. Mr. Hyden asked if the trucks are going to be parked on -site and Chair Tralle questioned if the trucks will be fueled on site. Ms. Larsen confirmed that the trucks will be parked and fueled on -site. Mr. Masonick and Mr. Laden had some questions for staff regarding the depth and drainage of the pits. Ms. Larsen and Diane Hankee, City Engineer, discussed drainage on the property and explained that it is already being accommodated by the stormwater management system in place. Chair Tralle and Mr. Kassner conferred with staff if the new buffer zone that the governor is proposing would come into play with this project. It would not. Chair Tralle declared the Public Hearing open at 6:47 p.m. Applicant Jeff Morell, 7860 Sunset Avenue, discussed an existing earth berm on the property as well as drainage. Mr. Morell also expressed his appreciation for the help he has received from city staff. Eddie Turner, 12270 Sunset Avenue, Blaine, was curious about the Century Farms North development. Chair Tralle and city staff provided Mr. Turner with some basic information about the development and offered to send him further information. Mr. Hyden made a MOTION to close the Public Hearing at 6:53 p.m. Motion was supported by Mr. Evenson. Motion carried 6 - 0. (Tralle abstained) Mr. Hyden made a MOTION to recommend approval of the conditional use permit, based on the following conditions: 1. All comments from the City Engineer letter dated August 4, 2015 shall be addressed. 2. A Temporary Access Easement shall be drafted by the applicant and submitted to the City for review and recording. 3. A Development Agreement shall be drafted by the City and executed by both parties and recorded. 4. Soil borings for the borrow pit area shall be submitted. 5. Traffic Generation: a. Equipment and vehicles shall not use the improved section of Robinson Drive for access to the borrow pit. DRAFT MINUTES Planning & Zoning Board August 12, 2015 Page 3 b. The hauling, dumping and grading of excavated materials shall occur within the boundaries of Century Farm North 6th Addition. c. Materials shall not be exported outside these boundaries. d. Truck traffic shall not access CR 53 except for mobilization, refueling and maintenance. Motion was supported by Mr. Kassner. Motion carried 6 - 0. (Tralle abstained.) B. Final Plat for NorthPointe 3rd Addition Ms. Larsen presented the staff report. Staff recommends approval of the plat. Mr. Masonick asked how many lots were in NorthPointe 1" and 2nd Addition. Ms. Larsen responded with the lot amounts. Larry Olson of Emmerich Development Corporation approached the podium to answer any questions. Mr. Evenson questioned the amount of lots being built, as there was originally scheduled to be 90 lots built during this phase. Mr. Olson explained that they altered their approach in order to advance construction. In the end they will still have the same amount of lots in the development as originally planned. Mr. Laden wondered if they are issuing permits in phase two yet. Ms. Larsen said that they have not started issuing permits yet. Mr. Olson pointed out that they have begun staking the houses, but they can't start issuing permits until the curb, gutter and blacktop is in. Mr. Masonick asked what percentage of the lots are already spoken for. Mr. Olson didn't have an exact percentage, but estimated that they have sold about 3/4 of the lots in phase one and about 2/3 of the wide lots in phase two. Mr. Hyden made a MOTION to recommend approval of the NorthPointe 3rd Addition Final Plat, subject to the following conditions: 1. All comments from City Engineer letter dated August 4, 2015 shall be addressed. 2. All comments from MNDOT letter dated July 20, 2015 shall be addressed. 3. A Development Agreement shall be drafted by the City, executed by the City and the developer and recorded by the developer. 4. The Phasing Plan shall be revised to reflect changes from the original plan. 5. A south bound by-pass lane on 201h Avenue/CSAH 54 at Red Oak Lane shall be constructed. a. The applicant shall coordinate with Anoka County on design and approval. b. The approved construction plans shall be submitted to the City. 6. A FEMA Letter of Map Revision shall be required by the City prior to any building permits being issued on lots affected by the floodplain. 7. Title Commitment: a. Dahl, Community Development Intern September 9, 2015 PUBLIC HEARING to Consider Text Amendment to NB, Neighborhood Business District to allow Veterinary Hospitals with Conditional Use Permit TA2015 — 001 Brian Hansen 6511 Ware Road Lino Lakes, MN 55014 N/A Complete Application Date: August 3, 2015 Environmental Board Meeting: N/A EDAC Meeting: N/A Park Board Meeting: N/A P & Z Board Meeting: September 9, 2015 City Council Meeting: October 12, 2015 60-Day Review Date: October 2, 2015 60-Day Extension: December 1, 2015 BACKGROUND Rice Creek Animal Hospital, located in the Spirit Hills Mall on Ware Road, started conducting veterinarian services five years ago for the neighborhoods in the surrounding area. Due to the growth of their local services, expansion is required to support the surrounding neighborhoods. The relocation site Rice Creek Animal Hospital has located is south of their current location on the southeast corner of Hodgson and Birch. This parcel is zoned as NB, Neighborhood Business District (§ 1007.110). Currently, Veterinary Hospitals are only permitted in the GB, General Business District (§ 1007.112) with a Conditional Use Permit. Following a land use application from Rice Creek Animal Hospital for a text amendment to allow for veterinarian services in areas zoned NB Districts; staff has researched the possibility of allowing Veterinary Hospitals in NB Districts with a conditional use permits. ANALYSIS Please remember the discussion about allowing Veterinary Hospitals to operate on parcels zoned NB, Neighborhood District isn't specific to one site but it will be applicable to all parcels in Lino Lakes zoned as NB, Neighborhood District. Lino Lakes Zoning Ordinance The current Lino Lakes zoning ordinance allows for Veterinary Hospitals in the GB, General Business District with a Conditional Use Permit. Section 1007.112 GB, General Business District: (8) Conditional Uses. Subject to applicable provisions of the Ordinance, the following are conditional uses in the GB District: These uses require a conditional use permit based upon the criteria and procedures outlined in § 1007.016 of this Ordinance. (n) Veterinary Hospitals provided that: 1. All areas in which animals are confined are located indoors and are properly soundproofed from adjacent properties. 2. Animal carcasses are properly disposed of in a manner not utilizing on -site garbage facilities or incineration and the carcasses are properly refrigerated during periods prior to disposal. 3. An indoor animal kennel is permitted as a use accessory to the veterinary hospital provided that: a. The number of animals boarded shall not exceed twenty (20). b. An indoor exercise area shall be provided to accommodate the periodic exercising of animals boarded at the kennel. No outdoor exercising of animals shall be permitted. c. A ventilation system shall be designed so that no odors or organisms will spread between wards or to the outside air and will be capable of completely exchanging internal air at a rate of at least twice per hour. Air temperature must be maintained between 60 and 75 degrees Fahrenheit. d. A room separate from the kennel area shall be provided of sufficient size to adequately separate animals that are sick or injured from healthy animals. 2 e. Indoor animal kennel floors and walls shall be made of non -porous materials or sealed concrete to make it non -porous. f. Animal wastes shall be flushed down an existing sanitary sewer system or enclosed in a container of sufficient construction to eliminate odors and organisms and shall be properly disposed of at least once a day. 4. The appropriate license is obtained from the City and the conditions of Chapter 503 relating to the keeping of animals are satisfactorily met. 5. All State Health Department and Minnesota Pollution Control Agency requirements for such facilities are met. Surrounding Communities The following analysis and research is associated with how surrounding cities zone Veterinary Hospitals, such as the Rice Creek Animal Hospital, in their city zoning ordinances. It is important to note that not all cities classify Neighborhood Business District the same, but looking at the definitions of those districts they are similar in comparison. Blaine — 30.10 Community Commercial (B-2) Intent - Intended to provide retailing and services of both a convenience and durable nature to shoppers, such as apparel, furniture, food, banking, and financial services for a trade area of nearby residential neighborhoods. 30.14 Conditional Uses a. Animal Hospitals Circle Pines—1320.01 C-I Neighborhood Commercial District Intent - For the purpose of this Section, a neighborhood commercial district is defined as a commercial district for local businesses or service establishments. 1320.04 Conditional Uses a. Animal Hospitals Forest Lake — §153.326 Neighborhood Commercial (NC) District Intent - To allow single multi -use commercial buildings containing convenience retail and service commercial uses at major intersections on small neighborhood scale sites where public sewer is available and sites are designated in the City of Forest Lake Comprehensive Plan. The district is intended to accommodate the basic needs of neighborhoods that would not otherwise have convenient access to retail areas in the city. 3 (E) Conditional Uses — Subject to applicable provisions of this chapter, the following are conditional uses in the NC District (requires a conditional use permit based upon procedures set forth in and regulated by § 153.034): (5) Veterinary Hugo — Sec. 90-104. — General Business District (C-2) Intent - The purpose of the C-2, general business district is to provide for the establishment of service and freestanding commercial businesses, including retail sales, offices, and restaurants, which are oriented toward motorists and require high volumes of traffic and visibility from major roads. (B) Permitted Uses (18) Veterinary Clinic — Small Animal (D) Conditional Uses — Following are conditional uses allowed in the C-2 district and require a conditional use permit based upon procedures set forth in and regulated by section 90- 37. Additionally, besides the specific standards and criteria, which may be cited below for respective conditional uses, each request for a conditional use permit shall be evaluated, based upon the standards and criteria in section 90-37. (18) Veterinary Clinic — Large Animal Lexington — 8-16 Neighborhood Business (B-1) Zone Intent - This zone is intended to accommodate neighborhood shopping facilities to serve the needs of the surrounding residential area. Generally, they should be planned facilities and should be located as recommended in the Comprehensive Plan. This zone should be oriented to the residential neighborhood, and should have a roadway system which will be adequate to accommodate the anticipated vehicular traffic. 8-16 (d) Conditional Uses (Permitted only with Board of Adjustment approval) 2. Animal Hospital or Clinic or clinic, provided that all exterior walls are completely soundproofed; and further provided that animal pens shall be completely within the principal building and used for the medical treatment of small animals. Maplewood — Division 8, - NC Neighborhood Commercial District Intent - To preserve land for the use of businesses that are compatible with adjacent residential land uses. Uses are limited to offices and smaller retail uses that cater to convenience shopping. Pedestrian and bicycle access are to be emphasized. Sec. 44-427. — Permitted Uses - Any of the following uses are permitted, provided that the floor area of all buildings in any one NC neighborhood commercial district shall not exceed 3,000 square feet: M 9. Veterinary Clinic or grooming clinic where there are no outside kennels or storage. Sec. 44-429. — Conditional Uses - Conditional uses for an NC neighborhood commercial district require council approval. Any of the following conditional uses are permitted, provided that the floor area of all buildings in any one NC district shall not exceed 8,000 square feet: 6. Other uses, such as Veterinary Clinic White Bear — §1303.120 "B-I ", Neighborhood Business District Intent - Neighborhood Business District is to provide for the establishment of local centers of convenient, limited office, retail or service outlets which deal directly with the customer for whom the goods or services are furnished. These centers are to provide services and goods only for the surrounding neighborhoods and are not intended to draw customers from the entire community. Subd. 4. Conditional Uses - The following are conditional uses in an "B-1" District, which require a conditional use permit based upon procedures and provisions set forth in and regulated by Section 1301.050 of this Code. f) Animal Clinics In summary, most communities allow for veterinary hospitals or clinics in "neighborhood" like zoning districts as a conditional use permit. Proposed Text Amendment Lino Lakes has 3 business zoning districts: NB, Neighborhood Business, LB, Limited Business and GB, General Business. As discussed, the GB, General Business is the only district to address veterinary hospitals. The purpose statements of the NB and LB district are as follows: § 1007.110 NB, NEIGHBORHOOD BUSINESS DISTRICT. (1) Purpose. The purpose of the NB, Neighborhood Business District is to provide for the establishment of local businesses for convenience, limited office, retail or service outlets which deal directly with the daily requirements of the immediate neighborhood and which are located along a collector or arterial roadway. These businesses are not intended to draw customers from the entire community. No new land shall be zoned NB, Neighborhood Business unless the site or area lies within the City's MUSA and sanitary sewer and municipal water are available. § 1007.411 LB, LIMITED BUSINESS DISTRICT. (1) Purpose. There may be some areas which are suitable only for commercial uses of a limited (less intense) nature. This may be due to the close proximity of residential uses. This may include high quality commercial areas such as an "office park" development. Also, the LB 5 District can be used as a transitional district or buffer between non -compatible uses such as intense commercial (GB) and residential uses. No new land shall be zoned LB, Limited Business unless the site or area lies within the City's MUSA and sanitary sewer and municipal water is available. Staff recommends amending the NB, Neighborhood Business District and LB, Limited Business District to allow for veterinary hospitals with a conditional use permit. Currently, there are 17 parcels zoned NB and 2 parcel zoned LB in the City. Staff will also note we have had no issues or concerns regarding the existing Rice Creek Animal Hospital located in the Spirit Hills mall in close proximity to residential homes and other retail business. Findings of Fact The Planning and Zoning Board shall consider possible adverse effects of the proposed amendment. Its judgement shall be based upon, but not limited to, the following factors: (a) The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. The proposed action of the text amendment is in relation to the specific policies and provisions of and is consistent with the official City Comprehensive Plan based upon the goals and policies set forth by Chapter 5 — Economic Development Plan. Goal 1: Expand and diversify the city's tax base by encouraging mixed -use and nodal development to lessen the tax burden on residential properties. Policy 3: Ensure commercial development is dispersed appropriately throughout the community and in designated business development areas. Policy 5: Integrate into neighborhoods those retail and service commercial activities that service the neighborhood. Goal 2: Work with developers to identify innovative strategies for attracting entry level and smaller entrepreneurial businesses to Lino Lakes. Policy 2: Work with the current business community, Chamber of Commerce and the city's EDAC to attract new businesses and expand the economic success of existing businesses. Goal 5: Promote Lino Lakes' location within the metropolitan region as an advantage in doing business. Policy 2: Collaborate with business support organizations to serve the needs of current and future businesses. 2 (b) The proposed use is or will be compatible with present and future land uses of the area. Future site specific development proposals to allow for a veterinary hospital with a conditional permit shall be analyzed for compatibility with present and future land uses. (c) The proposed use conforms with all performance standards contained herein. Future site specific development proposals to allow for a veterinary hospital with a conditional permit shall conform with all performance standards. (d) The proposed use can be accommodated with existing public services and will not overburden the City's service capacity. (e) Traffic generation by the proposed use is within capabilities of streets serving the property. RECOMMENDATION Staff is recommending a text amendment to the NB, Neighborhood Business District and LB, Limited Business District in Conditional Uses to allow for the operation of Veterinary Hospitals with the same 5 conditions required in the GB, General Business District. We are the founders and operators of Rice Creek Animal Hospital, a neighborhood veterinary hospital started within the Spirit Hills Mall five years ago. As any start up entrepreneur (and I am sure some of you can empathize), we have been so grateful to survive our early years and with the support of our neighbors, we have been incredibly grateful to have grown... so much so that we are in need of a new space. After much research and planning (including many visits to City Hall), we are in negotiations with the owners of the property immediately to the south of our current location on the corner of Hodgson and Birch (contingent on your response to our proposal). This property is perfect for our needs as it serves our existing clientele, is minutes from home, and quite honestly, respects our other local veterinary clinics (as there were more affordable property with even better visibility but encroached on our peers' existing businesses or was out of the Lino city limits). The only unfortunate notion associated with this property is it is zoned as neighborhood business (where veterinarians are not included). We would like to propose a change of the existing definition of neighborhood business to include veterinary hospitals. Hopefully some of the following points may help encourage you that veterinarians are applicable to your definition of neighborhood business and that Rice Creek Animal Hospital would be an appropriate use for this beautiful property (and a continued positive influence in our community): • Essentially, we feel we are indeed the definition of a "neighborhood" business. Over 90% of our business is within a 2 mile radius. We love our clients, live in the neighborhood, our children go to school here, and we offer discounts to our local police, fire, and EMTs as well as all of our military veterans. (And would welcome the opportunity to care for Officers Noll and Justice of the Lino PD- CONGRATS on earning the top title at the agility trial!). We already have police dogs stopping by our home on Friday nights... we'd be honored to have another! We support the high school athletic teams and have an annual open house inviting all of our neighbors to enjoy a fun day at the clinic. • The city's definition of neighborhood business includes similar scale businesses like dental offices, salons, etc. Our traffic generated would likely be similar (if not less) than these facilities so the transition for veterinary hospitals to be included in the category of neighborhood business should have no different traffic impact than the existing plans for the property. • In accordance to our existing conditional use permit, we do our best to soundproof our patient care facilities (ie kennel room) so that to not have excessive noise or bother (but truth be told, we do not frequently have barking or noisy patients as we do our best to be sure everyone is comfortable and content in their spaces). This will obviously be a bit less of a concern in a free standing facility compared to our existing leased space (where surprisingly, our friendly karate neighbors make more enthusiastic noises than our canine companions do!). • We are a respectful business. Veterinary hospitals of today are clean, quiet, and efficient. Our patients are leash walked outdoors to relieve themselves (and with the new free standing space- in a safe, privacy fenced area). All remnants are immediately collected and disposed of so as not to affect the landscape or hygiene of the property. • Our existing hospital hopefully feels more like your living room than a veterinary hospital. We strive to have a welcoming, warm environment that is comforting to both our four legged patients (well, occasionally three legged) and their two legged family. • We have a very timely service who help us respectfully care for any patients who have sadly made their way to the "rainbow bridge." • Any medical waste is disposed of according to HazMat regulations very similar to a dental office or other medical facility. A little about us if you would like to know: We are a family owned practice who have had the same staff since we opened (although we have had to add!). Brian, who is the veterinarian everyone knows as the doctor of Rice Creek Animal Hospital, is a 7 year Marine Corps veteran who moved to Minnesota during veterinary school. Donnell, a MN native, who is also a veterinarian but works at a local referral hospital (B1uePearl Veterinary Partners), helps with some of the background care and TLC of the clinic. Our staff are our family and care for the hospital as much as we do. We have two little kids, Eli- an old soul about to start first grade at Rice Lake Elementary and Duvall- a feisty to be pre-schooler about to start their early education program. The whole operation is our home away from home and we are hopeful our clients can sense that about our business. Bottomline, we are so grateful for our Lino community and excited to be in this bittersweet position of needing a new space. We are hopeful to build a prairie style building to match the native architecture and are excited to hang the sign Rice Creek Animal Hospital on our own piece of property. As you can imagine, we are anxious to get building as soon as possible both out of excitement and lease expiration so we are happy to do what is necessary to expedite the process as much as possible. We are hopeful you will see the value of opening your neighborhood business image to include a veterinary hospital. The Rush Line Corridor is an 80-mile travel corridor between St. Paul and Hinckley. A Pre -Project Development Study is underway to analyze bus and rail transit alternatives between Forest Lake and Union Depot in St. Paul. The study builds upon previous work completed for the corridor and will identify one mode and one alignment for adoption as the corridor's Locally Preferred Alternative. The PPD Study is a joint local and regional planning effort conducted by the Rush Line Corridor Task Force and led by the Ramsey County Regional Railroad Authority. ANALYSIS None.
