HomeMy WebLinkAbout2001-132 Council ResolutionCouncil member Carlson introduced the following resolution and moved its adoption: CITY OF LINO LAKES RESOLUTION NO. 2001-132 RESOLUTION ADOPTING AND CERTIFYING THE PRELIMINARY 2001 TAX LEVY, COLLECTIBLE IN 2002. WHEREAS, Minnesota State Statutes grant local governments the authority to levy property taxes to finance the operations of the local jurisdiction; and, WHEREAS, the City of Lino Lakes annually levies property taxes to finance General Fund operating costs and annual debt service on outstanding indebtedness; and, WHEREAS, the City Council of Lino Lakes has reviewed the proposed 2002 General Fund operating budget and the preliminary 2001 tax levy collectible in 2002; and, WHEREAS, to maintain its present level of service, the City's preliminary 2001 tax levy includes an amount to make up for the loss of Homestead and Agricultural Credit Aid (HACA), a state aid paid to cities to lower the property tax levy, that was eliminated by the state legislature beginning with the 2001/02 levy year; and, WHEREAS, the preliminary levy is the maximum that the City will levy for tax year 2001 collectible in 2002, and which may be lowered but cannot be increased before adopting the final tax levy; and, WHEREAS, the City Council must certify the preliminary 2001 tax levy collectible in 2002 to the Anoka County Auditor by September 15, 2001. NOW, THEREFORE, BE IT RESOLVED, that the City of Lino Lakes, Anoka County, Minnesota, hereby does levy on a preliminary basis the following upon taxable property in said City of Lino Lakes: 1. Total amount levied in the year 2001 to be spread for taxes due and payable in the year 2002 is $5,905,808. 2. The total amount above levied is for the following purposes: General Operating Levy $4,877,859 Special Levies Increased PERA Contribution 11,300 General Bonded Debt Public Project Revenue Bond 128,195 Civic Complex Bond 1998A 338,888 G.O. Improvement Bond 1998B 151,273 Equipment Certificates of 1999 114,082 Equipment Certificates of 2000 127,537 Equipment Certificates of 2001 156,674 Total General Obligation Bonded Debt 1,016,649 TOTAL LEVIES $5,905.808 Page 2 Adopted by the Lino Lakes City Council this 10th day of September, 2001. Simple Majority VOTE REQUIRED BACKGROUND Minnesota State Statutes require the City of Lino Lakes to adopt and certify a preliminary tax levy for the coming year on or before September 15th of each year. Legislative action during the last session has made a large impact on the City's levy for the coming year. The legislature took over funding of general education and compressed the property class rates for all classes of property. The state legislature also eliminated Homestead and Agriculture Credit Aid (HACA) to cities for this and future years. This funding will be used to offset the state's cost of general education funding. This leaves a large funding gap for the city if services are maintained at their present level. The legislature has allowed cities to increase their levy to make up this funding gap. The proposed levy for Lino Lakes includes such an increase to make up this difference. This increase will be more than offset by a decrease in the school district levy, which will be made up by the state. The net result should be a decrease in property taxes in 2002. The proposed levy may be decreased when the final levy is adopted in December. The final levy can not be more than the proposed levy. The total levy includes dollars for the general operating budget as well as dollars for general bonded debt. The levy will be further reviewed by the City Council and staff between September 15th and December 10th, for changes if necessary. OPTIONS 1. Adopt the proposed 2001 tax levy, collectible in 2002. 2. Return to Staff for further review. RECOMMENDATION' Option 1
