CITY OF LINO LAKES
RESOLUTION NO. 01-165
RESOLUTION RECEIVING PETITION AND ORDERING PREPARATION OF STUDY
FOR THE MARSHAN LANE UTILITY IMPROVEMENTS
WHEREAS, the City of Lino Lakes has received a petition from residents of Marshan
Lane, east of Lake Drive, requesting preparation of a study on the feasibility of
extending sanitary sewer and water service to their properties, and
WHEREAS, in response to this petition, it is proposed to improve Marshan Lane from
Lake Drive to the east by constructing sanitary sewer and watermain improvements, and
WHEREAS, the City proposes to assess the benefited property for all or a portion of the
cost of the improvement, pursuant to Minnesota Statutes, Chapter 429, and Chapter 8
of the Lino Lakes City Charter.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
LINO LAKES, MINNESOTA:
1. That the proposed improvement be referred to the City Engineer for study and
that he is instructed to report to the Council with all convenient speed advising
the Council in a preliminary way as to whether the proposed improvement is
necessary, cost-effective, and feasible and as to whether it should best be made
as proposed or in connection with some other improvement, and the estimated
cost of the improvement as recommended.

TOPIC: Resolution No. 01-165, Receive Petition and Order Preparation of
a Feasibility Study for the Marshan Lane Utility Improvements.
VOTE REQUIRED: Simple Majority
BACKGROUND:
The City has received a petition from residents and property owners on Marshan
Lane, east of Lake Drive, for preparation of a report on sanitary sewer and water
service. A copy of the petition and a sketch of the project area are attached.
Trunk sanitary sewer and water main are close to the project area at the
intersection of Lake Drive and Town Center Parkway.
When the City has received utility petitions from neighborhoods in the past, the
first step has been to hold a neighborhood meeting before any formal study is
prepared. At the neighborhood meetings, we discuss the public improvement
process, the City Charter, the location of existing utilities, and an overview of the
construction process. In this case, in response to verbal inquiries, the
neighborhood meeting was held on September 20, 2001, before any petition wa
received. On September 25, 2001, the City received a petition.
The study will address, on a preliminary basis, design, cost, assessment,
schedule, and other issues as they relate to providing City utility service to this
area.
OPTIONS:
1. Return to staff for further review.
2. Adopt Resolution No. 01-165, Receive Petition and Order Preparation of a
Feasibility Study for the Marshan Lane Utility Improvements.
RECOMMENDATION:
Option No. 2 - Staff recommends that Resolution No. 01-165 be adopted.

Petition for installation of Sanitary Sewer and Water

The undersigned hereby request the City of Lino Lakes to prepare a report concerning the
installation of sanitary sewer and water on Marshan Lane east of Lake Drive. The
undersigned are aware that if said sanitary sewer and water are installed by the City of
Lino Lakes the residents benefitting from the sewer and water will be assessed the costs
of the project.
