2001-168 Council Resolution
01-168 Council Member Dahl introduced the following resolution and moved its adoption. CITY OF LINO LAKES RESOLUTION NO. 01-168 RESOLUTION APPROVING A SITE AND BUILDING PLAN FOR McDONALD'S WHEREAS, McDonald's Corporation submitted an application for site and building plan approval, based on the site, grading and landscaping plans prepared by Ryan Engineering, received September 24, 2001 and building elevations prepared by McDonald's Corporation, received October 1, 2001; and WHEREAS, the Lino Lakes Planning & Zoning Board reviewed the project on October 10, 2001, and recommended approval with conditions, NOW, THEREFORE, BE IT RESOLVED, the Lino Lakes City Council approves the site and building plan as described in the staff report for the October 22, 2001 meeting of the City Council, with the following conditions: 1. Architectural Plans shall be provided for the trash enclosure to insure conformance with City requirements. 2. A photometric lighting plan and light fixture details shall be submitted and subject to review and approval by staff. All lighting used to illuminate off-street parking areas shall be hooded (i.e. shoe box fixtures) and arranged to deflect light away public streets and adjacent properties. 3. A revised Landscaping Plan shall be submitted subject to review and approval by staff prior to issuance of a building permit. 4. A tree preservation plan shall be submitted subject to review and approval by staff prior to the commencement of site grading activities. 5. A revised grading and drainage plan shall be submitted for review and approval by the City Engineer and Rice Creek Watershed District. 6. A utility plan shall be submitted for review and approval of the City Engineer. 7. All permits required by the Rice Creek Watershed District shall be obtained prior to any site grading. 8. All necessary permits must be obtained from Anoka County. 9. The property shall receive final plat approval prior to issuance of a building permit. AGENDA ITEM 7 E STAFF ORIGINATOR: Michael Grochala C.C. MEETING DATE: October 22, 2001 TOPIC: Resolution No. 01-168 McDonald's Site and Building Plan Review BACKGROUND The McDonald's project, located at the southeast corner of the Lake Drive/Apollo Drive intersection, previously received City Council approval on April 26, 1999 in conjunction with the JADT Development Group, LLP., Planned Development Overlay rezoning. A conditional use permit for the McDonald's drive-through was also approved at that time. Since the original approval date, the City has been working with JADT to facilitate the easterly extension of Apollo Drive to service the McDonald's site and the Market Place development. The City Council ordered the preparation of Plans and Specification for the Apollo Drive extension and Lake Drive improvements at the September 22, 2001 meeting. It is anticipated that construction will start in April of 2002 and be completed by mid June. In conjunction with the Market Place development City staff recommended changes to the McDonald's site plan to improve vehicle circulation and safety along Apollo Drive. These changes included the following: 1. Elimination of the right -in only access to McDonald's from Apollo Drive. 2. Realignment of the McDonald's service road to create a ninety (90) degree intersection with the proposed Market Place service road. 3. Relocation of access drive to the McDonald's parking lot to provide increased stacking distance on the service road from Apollo Drive These changes necessitated the need to rotate the McDonald's building on the site. McDonald's has accommodated these requests, however the changes did require resubmittal of the site plan for City approval. This review is based on the following updated plan submittals: Site Plan received 09/24/01 Landscape Plan received 09/24/01 Grading and Drainage Plan received 09/24/01 Building Elevations received 10/01/01 McDonald's Site and Building Plan Review October 22, 2001 Page 2 ANALYSIS Zoning: The property is zoned Planned Development Overlay District (PDO). The underlying zoning district is SC, Shopping Center. Vehicular Traffic: Access to the site is provided via a service road extended southerly from the proposed Apollo Drive extension. Building: McDonald's is proposing to construct a restaurant of approximately 3,870 square feet. The proposed building exterior, as shown in the attached building elevations, is consistent with the "retro" design previously approved by the Town Center Committee in April of 1999. Parking: The standards for access and traffic circulation are outlined in Section 3, Subdivision 5 of the Zoning Ordinance. A total of 58 parking spaces are required based on 15 spaces per 1,000 square feet of gross floor area. 72 spaces are provided, including three handicap accessible spaces in conformance with the Americans with Disabilities Act (ADA) requirements. The dimensions of the parking stalls and drive aisles are in conformance with City requirements. Trash Enclosure: Trash and recycling handling activities are to occur in an enclosed area on the northeast side of the site. Architectural design of the enclosure should be provided i.e., construction material, height. Lighting: The applicant's submission did not include a photometric lighting plan nor does the site plan illustrate exterior lighting locations. According to Section 3. Subd. 4.H of the Zoning Ordinance, any lighting used to illuminate an off-street parking area must be hooded and arranged to deflect light away from public streets and adjacent properties. As a condition of site and building plan approval, a photometric plan and light fixture details should be submitted subject to review and approval by the City. Signage: The pylon sign located in the southwesterly corner of the site was approved as part of the original site plan on April 26, 1999. The sign is forty (40) feet in height with a total surface area, exclusive of the trademark golden arches, of 76 square feet. No revision has been submitted or requested. Wall signage is proposed to consist of two 126 square foot signs located on the west and east faces of the building as well as a trademark golden arch on the north and south sides of the building. The signs are depicted on the attached building elevations. The underlying SC, Shopping Center District sign requirements only allows one wall sign, not to exceed 100 square feet. However, the PDO designation allows for greater flexibility than what is generally possible under conventional zoning requirements. Given that the proposed wall signage McDonald's Site and Building Plan Review October 22, 2001 Page 3 is integral to the "retro" design, previously approved by the Town Center Committee, staff is comfortable with the wall signs as proposed. Landscaping: The landscaping plan is generally consistent with the plan previously approved. Proposed tree types include Swamp White Oak (4), Northern Pin Oak (5), Norway Compact Pine (6), Quaking Aspen (12), White Spire Birch (5) and Coralburst Crabapple (3). A wildflower wetland seed mix is proposed within the infiltration basins. Staff is recommending that the four White Spire Birch, located within the parking lot islands, be replaced with a tree type more suitable to these specific locations. The four Quaking Aspens, located in the southeast corner of the site, should be relocated to allow for the future southerly extension of the service road. Additionally, those areas scheduled for native plantings and those for sod should be delineated on the landscaping plan. Irrigation must be provided for all sodded areas. A revised landscaping plan should be submitted that incorporates these comments. Tree Preservation: Four (4) existing oak trees are proposed to be preserved as part of the site development. As a condition of site and building plan approval, a tree preservation plan should be submitted. The existing tree inventory, dated _ March 26, 1999 should be overlaid with the revised site and grading plan to determine if additional preservation is possible due to the site changes. Trees and shrubs identified to be saved shall be protected to the drip line from all construction traffic and storage of materials with a safety fence and depicted on the preservation plan. The tree preservation plan shall be subject to approval by the City Environmental Specialist. Grading, Drainage: A grading and drainage plan has been submitted for review. The plan is generally consistent with the plans previously approved by Rice Creek Watershed District (RCWD) on October 15, 1999. Minor modifications have been made due to the building/parking lot layout change. It does appear that the grading of the infiltration basins located at the northeast corner of the site and east of the service road encroach upon the proposed Apollo Drive right-of-way. All grading should be modified so that the infiltration areas are contained within the project site. Additionally, the RCWD Permit expired on April 15, 2001. As such, the revised plans need to be resubmitted for approval by the Watershed District as well as the City Engineer. Utilities: No revised utility plans were submitted. The site is proposed to be serviced from the Apollo Drive extension per the previously submitted plans dated March 26, 1999. The plans will need to be modified to reflect the new alignment of the service road and the Apollo Drive utility extension design. Design of the sanitary sewer and water utilities should be coordinated with the Apollo utility design and be subject to the review and approval of the City Engineer. McDonald's Site and Building Plan Review October 22, 2001 Page 4 PLANNING & ZONING BOARD The request was reviewed by the Planning & Zoning Board at the October 10, 2001 meeting. The board recommended approval of the site and building plan subject to the conditions listed in this report. OPTIONS 1. Approval of the McDonald's site and building plan request subject to the conditions outlined in Resolution 01-168. 2. Table the application and request more information. RECOMMENDATION Staff recommends approval of the site and building plan subject to the conditions listed below (Option 1): 1. Architectural Plans shall be provided for the trash enclosure to insure conformance with City requirements. 2. A photometric lighting plan and Tight fixture details shall be submitted and subject to review and approval by staff. All lighting used to illuminate off- street parking areas shall be hooded (i.e. shoe box fixtures) and arranged to deflect light away public streets and adjacent properties. 3.
