HomeMy WebLinkAbout2002-006 Council ResolutionCITY OF LINO LAKES RESOLUTION NO. 02-06 RESOLUTION APPROVING A CONDITIONAL USE PERMIT AMENDMENT FOR THE CONSTRUCTION OF A PICNIC SHELTER FOR GETHSEMANE UNITED METHODIST CHURCH, 7330 LAKE DRIVE WHEREAS, an application has been submitted to the City for a conditional use permit amendment to allow the construction of a picnic shelter, and WHEREAS, the legal description of the property is: Tract A, Registered Land Survey No. 182 (PIN #17-31-22-33-0050) and WHEREAS, at their meeting on January 9, 2002, the Planning and Zoning Board conducted a public hearing to consider the application and recommended approval subject to the conditions listed in the meeting minutes; and WHEREAS, the City Council of the City of Lino Lakes makes the following findings of fact, as required by Section 2 Subd. 2.B.7 of the Zoning Ordinance: The proposed use at the proposed location, subject to the conditions contained herein: a. Will not be detrimental to or endanger the public health, safety, comfort, convenience or general welfare of the neighborhood or the City. b. Will be harmonious with the general and applicable specific plans and policies of the comprehensive plan of the City and this ordinance. c. Will be designed, constructed, operated, and maintained so as to be harmonious and appropriate in appearance with the existing and/or intended character of the general vicinity and will not change the essential character of that area. d. Will be served adequately by essential public facilities and services, including streets, police and fire protection, drainage structures, refuse disposal, water and sewer systems, and schools; or will be served adequately by such facilities and services provided by the persons or agencies responsible for the establishment of the proposed use. e. Will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community. f. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. g. Will have vehicular approaches to the property which are so designed as not to create traffic congestion or an interference with traffic on surrounding public thoroughfares. h. Will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. i. Will conform to specific standards of this ordinance applicable to the particular use. NOW, THEREFORE, BE IT RESOLVED, that the Lino Lakes City Council hereby approves the conditional use permit amendment subject to the following conditions: 1. Elimination of one existing detached accessory structure so that there are no more than two detached accessory structures on the site (including the proposed picnic shelter). 2. Decrease the size of the proposed picnic shelter so as not to exceed the total accessory square foot maximum of 2,020 sq.ft. cited in the City's Zoning Ordinance. 3. Roof materials should be compatible with the principle church building (no metal corrugated materials). 4. A building permit must be obtained for construction of the proposed picnic shelter. 5. Issuance of the building permit will not be granted until the right-of-way for Stage Coach Trail extending to the north property line of Parcel B, as shown on the attached Exhibit A, is dedicated to the City.
