HomeMy WebLinkAbout2002-141 Council ResolutionCITY OF LINO LAKES RESOLUTION NO. 02-141 RESOLUTION FOR HEARING ON PROPOSED ASSESSMENT FOR THE INDIVIDUAL PROPERTIES WHICH REQUESTED CONNECTION TO CITY UTILITIES WHEREAS, by a resolution passed by the City Council on September 23, 2002, the City Clerk was directed to prepare a proposed assessment for the individual properties which requested connection to City utilities, and WHEREAS, the Clerk has notified the City Council that such proposed assessment has been completed and filed in her office for public inspection, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF LINO LAKES, MINNESOTA: 1. A hearing shall be held on Monday, October 28, 2002 in the City Hall, 600 Town Center Parkway, Lino Lakes, Minnesota, at 6:30 P.M. to pass upon such proposed assessment and at such time and place all persons owning property affected by such improvement will be given an opportunity to be heard with reference to such assessment. 2. The City Clerk is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two (2) weeks prior to the hearing, and she shall state in the notice the total costs of the improvement. She shall also caused mailed notice to be given to the owners of each parcel described in the assessment roll not less than two (2) weeks prior to the hearings. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Clerk except that no interest shall be charged if the entire assessment is paid within thirty (30) days from the adoption of the assessment. He may at any time thereafter, pay to the City Clerk the entire amount of the assessment remaining unpaid, with interest accrued to December 31, of the year in which payment is made. Such payment must be made before November 15, or interest will be charged through December 31 of the succeeding year. Adopted by the Council of the City of Lino Lakes t ' 23rd day of September, 2002. 1 John J ergcson, ayor Ann BlairaCity Clerk CITY OF LINO LAKES NOTICE OF HEARING ON PROPOSED SPECIAL ASSESSMENT INDIVIDUAL PROPERTIES WHICH REQUESTED CONNECTION TO CITY UTILITIES NOTICE IS HEREBY GIVEN, that the Council of the City of Lino Lakes, Minnesota will hold a public hearing on proposed special assessments for individual properties which requested connection to City utilities. Such hearing will be held at the City Hall, 600 Town Center Parkway, Lino Lakes, Minnesota, on Monday, October 28, 2002, 6:30 p.m. or as soon thereafter as the matter can be reached on the agenda. Adoption of the proposed assessment may be done at the hearing. The properties affected include the following: 274 Apollo Drive 7582 4th Avenue 718 Main Street 7997 Lake Drive $60,911.86 $37,936.01 $ 9,109.54 $36,857.66 The improvements include sanitary sewer, water, and drainage. The total amount of the proposed assessment is $83,903.21. The proposed assessment roll showing the amount to be assessed against each parcel is on file with the City Clerk and is open to public inspection during normal business hours of the City Clerk. At the hearing, written or oral objections to the proposed assessments by any property owner will be considered. No appeal may be taken as to the amount of any assessment adopted after the hearing unless a written objection signed by the affected property owner is filed with the City Clerk prior to the assessment hearing or is presented to the Mayor at the hearing. An owner may appeal an assessment to District Court pursuant to Minnesota Statute 429.081 by serving notice upon the Mayor or Clerk of the City within 30 days after the adoption of the assessment and by filing such notice with the District Court of Anoka County within ten (10) days after service of the notice of appeal upon the Mayor or Clerk. City Ordinance No. 07-90 provides for deferment of special assessments for those 65 years of age or older that also meet certain income and asset limitations. Studenski, City Engineer COUNCIL MEETING DATE: September 23, 2002 TOPIC: Consideration of Resolutions 02-137 through 02-141 Setting Public Hearings for Proposed Assessment VOTE REQUIRED: 3/5 Vote Required BACKGROUND: It is expected that City Council will adopt the resolutions declaring the costs to be assessed and ordering the preparation of the assessment rolls for the projects to be assessed. The following resolutions set the date for the public hearings for Monday, October 28, 2002 on the assessments to each of the projects. The developer projects to be assessed are as follows: West Shadow Ponds Royal Pines Clearwater Creek 5th Addition Lake Drive/Apollo Drive Improvements There are also several property owners who connected to City utilities this past year and requested the assessments be collected with their taxes. Each resolution will require a separate vote of the City Council. OPTIONS: 1. Adopt separate motions for each resolution. 2. Return to staff for further review. RECOMMENDATION: Staff recommends Option No. 1, the adoption of the resolution for each project and for the individual properties that connected.
