BACKGROUND
Simple Majority (3/5)
Mr. Kelley Kimball met with the City Council at its work session on November 6 to negotiate a
solution to his water consumption dispute. After a lengthy discussion, the consensus of the
Council was that, while the consumption measured by Mr. Kimball's meter appeared to be
accurate, penalty fees incurred during the period of the dispute should be waived.
Staff has prepared Resolution No. 02-167 that waives $591.88 in penalty fees incurred to Mr.
Kimball's account over the last year and provides for the certification of the remaining delinquent
balance of $1,626.31 if not paid by November 25. The resolution has been forwarded to Mr.
Kimball who has concurred with the language.
