RESOLUTION NO. 02-172
RESOLUTION AMENDING THE ARTICLE VL, OF THE
DEVELOPMENT REGULATIONS TASK FORCE BY-LAWS
WHEREAS, The City Council, on January 14th, 2002 adopted Resolution No. 02-03
establishing the Development Regulations Task Force (DRTF) for the purpose of
reviewing and recommending amendments to the City's zoning and subdivision codes in
order to implement the Comprehensive Plan; and
WHEREAS, The establishment of the DRTF included the approval of By-laws to govern
the actions of said taskforce, of which Article VI established the date of November 30,
2002 for termination of the Task Force; and
WHEREAS, The DRTF has requested a thirty (30) day time extension to allow for the
complete review of the proposed amendments; and
WHEREAS, The City Council finds that it is in the best interests of the City to have the
Development Review Task Force complete its review of the proposed subdivision and
zoning ordinance amendments and make a recommendation on the entirety of the
proposed amendments.
NOW, THEREFORE, BE IT RESOLVED, the Lino Lakes City Council hereby amends
Article VI., Sunset Clause, of the Development Regulations Task Force Bylaws to read as
follows:
The DRTF shall complete all revisions and terminate on or before December 30, 2002 or
by simple majority vote of the City Council. In the event that the DRTF terminates prior
to the completion of its charge the responsibility of completing its purpose shall fall to
the City Council or its designee.

Amending DRTF By-laws
In January of 2002, the City Council established the Development Regulations
Task Force (DRTF) for the purpose of reviewing and recommending proposed
amendments to the City's Zoning and Subdivision Ordinances to implement the
City's Comprehensive Plan. To insure timely completion of the project, the
Council adopted By-laws for the task force that included a November 30, 2002
termination date.
Staff had intended to complete the ordinance review process at the November
21, 2002 DRTF meeting. However, the DRTF was unable to complete a
satisfactory review of the final two sections covering General Provisions and
Planned Unit Developments. Given the importance of these two sections, the
DRTF did not want to approve them without a more thorough examination of the
issues. Additionally, due to the upcoming Thanksgiving holiday, the task force
was unable to set a meeting date prior to the stated termination date. As such,
the task force is requesting a thirty (30) day extension to complete the work. In
anticipation of council approval, the task force has scheduled a meeting for
Thursday, December 5, 2002.
The originally proposed schedule anticipated completion of the DRTF review in
November and forwarding of the draft Zoning Ordinance to the Planning and
Zoning Board for action in December. Extending the DRTF deadline will
necessitate the need to shift the P & Z review to January and consequently the
council review to February. The moratorium on residential development is
scheduled to expire on February 22, 2002. The first and second readings of the
ordinance by the council would then be held on February 10 and February 24,
2002, respectively. Following council approval, the ordinance would be
published on March 3, 2002 and, in accordance with City Charter provisions,
effective 30 days after on April 2, 2002.
While the moratorium would expire prior to the effective date of the ordinance,
staff does not anticipate new applications being brought to the Planning and
Zoning Board for review until April 9, 2002. Applications for new development
may be submitted to the City following expiration of the moratorium. However,
there would not be sufficient review time between the expiration date and the
March 12, 2002 Planning and Zoning Board meeting. Applications submitted on
February 22, 2002 could be forwarded to the Planning & Zoning Board in April,
then proceed to the City Council for action within the allotted 120 day time
requirement for agency action. As such, the new ordinance requirements would
be in effect prior to required City action.
If the extension is not granted, the responsibility of completing the ordinance
review will revert to the City Council or its designee. The Council would have the
option of; 1) completing the review prior to sending it to the Planning & Zoning
Board or; 2) having the Planning and Zoning Board complete the review. Either
case it would require scheduling a special Planning and Zoning Board meeting to
allow for a 10 day public notice period.
Staff is recommending amending Article VI., of the Development Review Task
Force By-laws by changing the termination date to December 30, 2002.
OPTIONS:
1. Approve Resolution 02-172 amending Article VI. of the Development Review
Task Force By-laws.
2. Do not approve Resolution 02-172.
