HomeMy WebLinkAbout2002-174 Council ResolutionCITY OF LINO LAKES RESOLUTION NO. 02-174 RESOLUTION APPROVING SITE AND BUILDING PLANS AND A CONDITIONAL USE PERMIT FOR A FULL SERVICE CARWASH, A SELF- SERVICE CARWASH AND A QUICK LUBE FACILITY WHEREAS, the City has received an application for a site and building plan review and a conditional use permit to allow a full service carwash, a self-service carwash and a quick lube facility; and WHEREAS, the legal description of the property is: (see ATTACHMENT A) ; and WHEREAS, the subject property is zoned LI, Light Industrial; and WHEREAS, the site and building plan/conditional use permit approval request is based on the following plans prepared by Designery Architecture, Glen Rehbein Companies and LSI Industries and related correspondence: Preliminary Site Plan dated 11/22/02 Grading, Drainage & Erosion Control Plan dated 11/22/02 Utility Plan dated 11/22/02 Landscape/Tree Preservation Plan dated 11/22/02 Floor Plan dated 11/22/02 Building Elevations dated 11/22/02 Lighting Plan submitted 11/25/02 TKDA Engineering Comments dated 11/5/02 Environmental Board Comments dated 11/4/02 ; and WHEREAS, at their meeting on November 13, 2002, the Planning & Zoning Board considered the site and building plans and conditional use permit application and recommended approval subject to the conditions listed in the meeting minutes; and WHEREAS, the City Council of the City of Lino Lakes makes the following findings of fact, as required by Section 2 Subd. 2.B.7 of the Zoning Ordinance which establishes conditional use permit evaluation criteria. a. This application will not be detrimental to or endanger the public health, safety, comfort, convenience or general welfare of the neighborhood or the City. b. This application will be harmonious with the general and applicable specific plans and policies of the Comprehensive Plan of the City and the Zoning Ordinance. c. This application will be designed, constructed and operated, and maintained so as to be harmonious and appropriate in appearance with the existing and/or intended character of the general vicinity and will not change the essential character of that area. d. This application will be served adequately by essential public facilities and services, including streets, police and fire protection, drainage structures, refuse disposal, water and sewer systems, and schools; or will be served adequately by such facilities and services provided by the persons or agencies responsible for the establishment of the proposed use. e. This application will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community. f. This application will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. g. This application will have vehicular approaches to the property that are so designed as not to create traffic congestion or an interference with traffic on surrounding thoroughfares. h. This application will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. i. This application will conform to specific standards of the Zoning Ordinance applicable to the particular use. WHEREAS, the City Council of the City of Lino Lakes makes the following findings of fact, as required by Section 7 Subd. 5.H.2 of the Ordinance which establishes "commercial carwashes" as conditionally permitted uses in LI, Light Industrial zoning districts provided that: a. The site is serviced by municipal sanitary sewer. b. The architectural appearance and functional plan of the building and site shall not be so dissimilar to the existing buildings or areas as to cause impairment in property values or constitute a blighting influence. c. Magazining or stacking space is constructed to accommodate that number of vehicles that can be washed during a maximum thirty (30) minute period and shall be subject to the approval of the City Engineer. d. At the boundaries of a residential use or district, a strip not less than ten (10) feet shall be landscaped and screened in compliance with Section 3, Subd. 4.S of the Ordinance. e. Parking or magazine storage space shall be screened from view of abutting residential districts in compliance with Section 3, Subd. 4.S. of the Ordinance f. The entire area other than occupied by building or plantings shall be surfaced with a concrete or bituminous material which will control dust and drainage which is subject to the approval of the City Engineer. g. The entire area shall have a drainage system which is subject to approval of the City. h. Vehicular access points shall be limited, shall create a minimum of conflict with through traffic movement and shall be subject to the approval of the City Engineer. i. All signing and informational or visual communication devices shall be in compliance with Appendix C of the City Code. j. Provisions shall be made to reduce noise. NOW, THEREFORE, BE IT RESOLVED that the City Council of Lino Lakes hereby approves the site and building plans and a conditional use permit to allow a full service carwash, a self-service carwash and a quick lube facility subject to the following conditions: 1. The two lots, which comprise the subject property, be legally combined. 2. The acceptability of the proposed curb cut location and width as well as the need for associated roadway improvements (i.e. turn lanes) be subject to comment and recommendation by the City Engineer and the Anoka County Highway Department. 3. Building colors be as specified on building elevations dated 11/18/02. 4. All off-street parking areas and associated drive lanes (including the planting medians on the east side of the building) be provided a continuous concrete curb. 5. The one-way bypass lane around the perimeter of the building be striped and thereby segregated from adjacent stacking lanes. 6. The source of all site lighting be hooded and controlled so as not to illuminate adjacent properties or public rights-of-way. More specifically, low -impact, downward -focused, low spill, low intensity fixtures shall be used as specified lighting plan submitted 11/25/02. 7. All trash be stored indoors. 8. All site signage comply with the applicable requirements of the Sign Code. 9. The conditions of the TKDA letter (dated 12/10/02) related to grading, drainage and utilities are satisfied. 10. Prior to building permit issuance, the applicant secure a utility easement from the school district to allow the proposed sewer pipe to overlay school district property. 11. Prior to the commencement of any site work, the applicant enter into a development agreement with the City and post all the necessary securities required by it. The agreement shall also contain an operation and maintenance agreement. 12. The Landscaping Plan shall be modified to incorporate additional screening along the westerly side of the development. Such screening shall be in the form of coniferous plantings. The applicant may utilize adjacent school district property to satisfy this requirement provided that appropriate documentation, in a form approved by the city attorney, is provided granting permission by the school district to perform such activities.
