CITY OF LINO LAKES
RESOLUTION NO. 00-43
RESOLUTION ORDERING THE IMPROVEMENT AND PREPARATION OF PLANS
AND SPECIFICATIONS - APOLLO DRIVE PHASE 4
WHEREAS, a resolution of the City Council adopted the 10th day of April, 2000, fixed a
date for a council hearing on the proposed improvement for Apollo Drive Phase 4 by
constructing sanitary sewer, watermain, street and storm sewer.
WHEREAS, ten days' mailed notice and two weeks' published notice of the hearing was
given, and the hearing was held earlier this evening, at which time all persons desiring
to be heard were given an opportunity to be heard thereon,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
LINO LAKES, MINNESOTA:
1. The City Engineer, John Powell, is hereby designated as the engineer for this
improvement. The engineer shall prepare plans and specifications for the making of
such improvement.
Adopted by the Lino Lakes City Council this 24th da of April, 2000.

The motion for adoption of the foregoing resolution was duly seconded by Council

TOPIC: Resolution No. 00-43, Order the Improvement and Preparation of Plans
and Specifications for Apollo Drive Phase 4
VOTE REQUIRED: 4/5 Vote Required
BACKGROUND:
After the Public Hearing for this is held, the next step in the Public Improvement Process
is to order the improvement and preparation of the plans and specifications. As this
project was initiated by the City Council, a 4/5 vote is required to order the improvement.
As the timetable for this project indicates, several actions are required this evening in
order to expedite construction of these improvements to serve the proposed McDonald's
restaurant.
OPTIONS:
1. Return to staff for further review.
2. Adopt Resolution No. 00-43 order the improvement and preparation of plans and
specifications for the Apollo Drive Phase 4 project.
RECOMMENDATION:
Option No. 2 - Adopt Resolution No. 00-43 order the improvement and preparation of
plans and specifications for the Apollo Drive Phase 4 project.
