Motion carried on a voice vote. 28 29 ITEM ACTION 30 31 Consideration of Expenditures: 32 33 July 13, 2105 (Check No. 101659 — 34 101782, $1,161,576.81) Approved 35 36 Centennial Fire District (Check No. 7007- 37 7024, $27,676.78) Approved 38 39 June 22, 2015 Council Work Session Minutes Approved 40 41 June 22, 2015 City Council Meeting Minutes Approved 42 43 Resolution No. 15-71, Peddler License for Edward 44 Jones Financial Advisors Approved 45 COUNCIL MINUTES July 13, 2015 APPROVED 46 Resolution No. 15-72, Parade/Run Permit for St. Joseph's 47 Parish Summer Festival Approved 48 49 50 FINANCE DEPARTMENT REPORT 51 52 There was no report from the Finance Department. 53 54 ADMINISTRATION DEPARTMENT REPORT 55 56 3A) On -Sale and Off -Sale Liquor Regulations, Consider Amendments to the City Code 57 (concurrent with 2015 State Law changes): 58 i. 1st Reading of Ordinance No. 05-15, Amending Section 701.02, Subdivision 1, to 59 allow the off -sale of growlers on Sunday; 60 ii. 1st Reading of Ordinance No. 04-13, Amending Section 701.09, Subdivision 3, 61 regarding Sunday on -sale hours 62 63 City Clerk Bartell explained that there were several changes to liquor regulations that were adopted 64 by the State Legislature this year. Two of those amendments are options that cities may choose to 65 adopt into their local laws. The council has reviewed the changes at a recent work session. Liquor 66 license holders have been informed of the state laws changes as well. 67 68 Ordinance No. 05-15 would allow licensed brewers to off -sale growlers on Sunday, if the city allows 69 the sale of growlers generally. The city may establish the hours that this off -sale may occur. If the 70 council wishes to adopt the new law, staff recommends that the hours be the same as off -sale hours 71 for all other days. 72 73 Ordinance No. 04-15, is based on what is commonly being referred to as the "Bloody Mary Law". 74 This new law allows cities to change the on -sale hours that liquor may be sold on Sunday to as early 75 as 8:00 a.m. The new sale hours are limited to restaurants, clubs, bowling alleys and hotels. 76 77 Ms. Bartell noted that there has been interest in both of the changes from license holders in the city. 78 79 Mayor Reinert noted that the city has been reviewing its regulations and making some changes lately 80 and he believes that it helps the city stay on trend with businesses and even attract new businesses. 81 He noted several new restaurants that have recently opened in the city. 82 83 Council Member Kusterman moved to approve the 1st Reading of Ordinance No. 05-15 as presented. 84 Council Member Roeser seconded the motion. Motion carried on a voice vote. 85 86 Council Member Kusterman moved to approve the 1st Reading of Ordinance No. 04-15 as presented. 87 Council Member Roeser seconded the motion. Motion carried on a voice vote. 88 89 3B) Consider Hiring PT Scanner Operator — City Clerk Bartell noted the ongoing project to 90 digitize city records. In order to handle scanning of the large amount of back records, the city has 2 COUNCIL MINUTES July 13, 2015 APPROVED 91 hired part-time scanners. At this time there is an opening for one individual in this position and after 92 a hiring process, staff is recommending that the council approve Ms. Kristine Kroll. 93 94 Council Member Rafferty moved to approve the hiring of Ms. Kroll as recommended. Council 95 Member Stoesz seconded the motion. Motion carried on a voice vote. 96 97 3C) Considering Hiring Community Development Intern- Community Development Director 98 Grochala explained that this intern position that handles a variety of support functions in the 99 department is currently authorized but vacant. He is recommending that the council hire Mr. Keith 100 Dahl to fill the position. 101 102 The mayor noted that this position fills some of the gap left by the vacancy of the Economic 103 Development Coordinator position, but at a much lower cost. Mr. Grochala noted that an intern 104 program also allows people to gain experience. 105 106 Council Member Rafferty moved to approve the hiring of Mr. Dahl as recommended. Council 107 Member Stoesz seconded the motion. Motion carried on a voice vote. 108 109 3D) Consider Hiring Solid Waste Intern- Community Development Director Grochala noted 110 that this intern position is also currently vacant and he is recommending that the city hire Aubrey 111 Fonfara. He noted that funding for this position is available through grant funds from Anoka County. 112 113 Mayor Reinert discussed the link between having this intern position and receiving the grant funds. 114 It is a position that is directly linked to receiving outside grant funds and would no doubt go away if 115 and when those funds aren't received. 116 117 Council Member Kusterman moved to approve the hiring of Ms. Fonfara as recommended. Council 118 Member Roeser seconded the motion. Motion carried on a voice vote. 119 120 3E) Resolution No. 15-70, On -Sale and Sunday Sales Liquor License for Don Julio- City 121 Clerk Bartell reported that the city has received an application for an On -Sale with Sunday Sales 122 liquor license for the restaurant Don Julio's that plans to open this fall at 701 Apollo Drive. Their 123 application process is complete, the related fees have been explained and insurance information has 124 been provided to the City as required. In accordance with the Lino Lakes Code of Ordinances, this 125 application requires approval by the City Council. 126 127 Coucnil Member Reoser moved to approve Resolution No. 15-70 as presented. Motion carried on a voice vote. 129 130 3F) Resolution No. 15-69, Special Event Permit for Fiesta Cancun Grand Opening event, to 131 be held on July 24, 25 and 26, 2015- City Clerk Bartell reviewed the request of this new restaurant 132 for a special event to celebrate a grand opening. Staff has reviewed the plans for safety and 133 compliance to city regulations. Council Member Stoesz confirmed that the music component is for 134 only two nights even though the event is planned for three. 135 3 COUNCIL MINUTES July 13, 2015 APPROVED 136 Council Member Roeser moved to approve Resolution No. 15-69 as presented. Motion carried on a voice vote. 138 139 PUBLIC SAFETY DEPARTMENT REPORT 140 141 4A) Consider Hiring Paid On -Call Firefighters — Police Chief Swenson requested that the 142 council authorize hiring of four firefighters. He reviewed the extensive pre -hiring process used by 143 the department. These members would begin training in August if hired by the city. 144 145 Council Member Roeser moved to approve the hiring of Anne Burton, Jeffrey Frid, Sean Mooney and 146 Kyle Torres as recommended. Council Member Stoesz seconded the motion. Motion carried on a 147 voice vote. 148 149 4B) Public Safety Department Update — Chief Swenson provided the following update: 150 - Fire Station Project - the project is moving ahead of schedule; 151 - Staffing - with the addition of the four new hires tonight, the Fire Department is at 38 total, 152 with a new training class beginning at Century College on August 24 and those students fully 153 certified by mid-December and the department and staff members ready to go live in January; 154 - Apparatus: One engine purchased by the city is ready to go and is being used in training; the 155 other truck is being prepared and will be ready for viewing on Night to Unite; 156 - Policies: written department policy is complete and will roll out with training. 157 158 Mayor Reinert noted the good numbers being seen in recruitment of firefighters. 159 160 Council Member Roeser gave an update on the Centennial Fire Steering Committee meeting. There 161 are impacts being seen with the changes coming There will be budget impacts and some service 162 changes for the cities in the district. 163 164 Mayor Reinert noted that there are many reasons that the council made the change to a city 165 department. It will be an improvement for public safety for the city. 166 167 PUBLIC SERVICES DEPARTMENT REPORT 168 169 5A) Consider Hiring Streets Maintenance Worker — Community Development Director 170 Grochala explained that this is a back fill position related to a recent resignation. This is a general 171 maintenance street position with additional assignment to utilities as needed. 172 173 Council Member Rafferty moved to approve the hiring of Kyle Gray as recommended. Council 174 Member Stoesz seconded the motion. Motion carried on a voice vote. 175 176 COMMUNITY DEVELOPMENT DEPARTMENT REPORT 177 178 6A) Resolution No. 15-73, Authorizing Acquisition of Temporary and Permanent Easements, 179 Birch Street Utility and Turn Lane Improvements — Community Development Director Grochala 4 COUNCIL MINUTES July 13, 2015 APPROVED 180 noted that this easement is required as part of the Birch Street project. The property owner has 181 agreed to the easements and will receive compensation. 182 183 Council Member Kusterman moved to approve Resolution No. 15-73 as presented. Motion carried on a voice vote. 185 186 6B) 2°d Reading of Ordinance No. 03-15, Vacating a Drainage and Utility Easement for 187 Turnberry Crossing Second Addition - City Planner Larsen briefly reviewed Ordinance No. 03-15 188 providing for vacation of a drainage and utility easement. The change is required based on the 189 amended plans for this development. 190 191 Council Member Rafferty moved to dispense with the full reading of the ordinance. Council Member 192 Stoesz seconded the motion. Motion carried on a voice vote. 193 194 Council Member Roeser moved to approve the 2"d Reading and adoption of Ordinance No. 03-15 as 195 presented. Council Member Kusterman seconded the motion.
