RESOLUTION NO. 61 - 89
RESOLUTION VACATING A PORTION OF EASEMENT FOR DRAINAGE DITCH,
LOT 3, BLOCK 12, SUNSET OAKS, 140 MARVY STREET, LINO LAKES,
MINNESOTA
WHEREAS: David Rouch, 140 Marvy Street, Lino Lakes,
Minnesota has petitioned the City to vacate certain
drainage easements from his lot described above and
shown on the attached map, and
WHEREAS: this request has been reviewed by the City Engineer
and the City Public Works Director and not adverse
future problems were noted, and
WHEREAS: a public hearing was held on September 11, 1989
before the City Council in the city hall after due
published and posted notice had been given by the
Clerk on August 21, 1989 and August 29, 1989 and
all persons interested were given an opportunity to
be heard; and
WHEREAS: it appears that it will be for the best interest of
the City to vacate such portion of the drainage
ditch, and
WHEREAS: four fifths of all the members of the Council
concur in this resolution,
NOW THEREFORE, BE IT RESOLVED that the portion of the
drainage ditch described above and shown on the attached map
is hereby vacated.
Adopted by the Council of the City of Lino Lakes this 11th
day of September, 1989.
