RESOLUTION NO. 06 — 90
RESOLUTION CLARIFYING MOTION OF SEPTEMBER 25, 1989 ORDERING
IMPROVEMENT AND PREPARATION OF PLANS FOR SECOND AVENUE
WHEREAS: a resolution of the City Council adopted the twenty
fifth day of August, 1988, fixed a date for a
Council hearing on the proposed improvement of
Second Avenue beginning at Lake Drive north to Elm
Street,
AND WHEREAS: ten days' mailed notice and two weeks'
published notice of the hearing was given, and the
hearing was held thereon on the twenty sixth day of
September, 1988, at which all persons desiring to
be heard were given an opportunity to be heard
thereon,
AND WHEREAS: the matter was considered at the November 28,
1988 Council meeting and action on this matter was
delayed,
AND WHEREAS: a motion was made at the September 25, 1989
regular Council meeting by Council Member Bisel to
proceed with the Second Avenue improvement and this
motion was duly seconded by Council Member Reinert
and passed unanimously,
AND WHEREAS: this motion was not made part of a resolution
ordering the improvement and the plans and
specifications for the improvement as required by
State Statutes No. 429,
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
LINO LAKES, MINNESOTA:
1. Such improvement is hereby ordered as proposed in the
Council resolution adopted August 25, 1988.
2. Mr. Darrell Schneider of TKDA is designated as the
Engineer for this improvement. He shall prepare plans
and specification for the making of such improvement.
Adopted by the Council this 12th day of March, 1990.
