CITY OF LINO LAKES
RESOLUTION NO. 43 - 91
RESOLUTION RECEIVING A REPORT FOR THE INSTALLATION OF
SANITARY SEWER AND MUNICIPAL WATER FOR THE GORDON AND KATIE
ALLEN PROPERTY, 473 BIRCH STREET, LINO LAKES, MINNESOTA
WHEREAS: pursuant to resolution the Council adopted
April 22, 1991, a report has been prepared
by Darrell Schneider, TKDA with reference to the
installation of sanitary sewer and municipal water
for the Gordon and Katie Allen property, 473 Birch
Street, Lino Lakes, Minnesota, and this report was
received by the council on May 13, 1991.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF LINO
LAKES, MINNESOTA:
1. The Council will consider the improvement of
installation of sanitary sewer and municipal water for
473 Birch Street, Lino Lakes, Minnesota and the
assessment of the benefited property for all or a
portion of the cost of the improvement pursuant to
Minnesota Statutes Chapter 429 and Chapter 8 of the Lino
Lakes City Charter at an estimated total cost of the
improvement of $
2. Mr. Gordon and Katie Allen have signed a Waiver of all
rights to a hearing on the conducting of a local
improvement which will benefit their property and
furthermore waived all rights to appeal under the Lino
Lakes City Charter and/or Minnesota Statute 429
concerning the benefit of the improvement provided that
the assessment to be levied against their property for
such improvement does not exceed $9,500.00. NO PUBLIC
HEARING IS ORDER OR WILL BE HELD BY THE CITY COUNCIL.

The motion for the adoption of the foregoing resolution was
duly seconded by Reinert and upon vote being taken
thereon, the following voted in favor thereof: Neal, Bisel,
Reinert, Bohjanen.
The following voted against same: None, Council Member Kuether was absent.
Where upon said resolution was declared duly passed and
adopted.
