HomeMy WebLinkAbout1996-140 Council ResolutionCITY OF LINO LAKES RESOLUTION NO. 96-140 RESOLUTION VACATING A PORTION OF THE DRAINAGE AND UTILITY EASEMENT OVER OUTLOT A OF COUNTRY LAKES ESTATES WHEREAS, Birchwood Builders, developer of Country Lakes Estates, has requested that a portion of the drainage and utility easement over Outlot A of Country Lakes Estates be vacated, and WHEREAS, the portion of the easement to be vacated is legally described as follows: Commencing at the most easterly corner of said Outlot A; thence North 42 degrees 50 minutes 28 seconds West, plat bearing along the northeasterly line of said Outlot A, a distance of 120 feet; thence South 45 degrees 53 minutes 15 seconds West, 10 feet to the point of beginning; thence continuing South 45 degrees 53 minutes 15 seconds West, 92.71 feet; thence South 57 degrees 52 minutes 52 seconds East, 120 feet, more or less, to a line being 10 feet northwesterly of and concentric with an easterly line of said Outlot A; thence northeasterly along said concentric line to a line that bears South 42 degrees 50 minutes 28 seconds East from the point of beginning; thence North 42 degrees 50 minutes 28 seconds West, along said line, to the point of beginning. WHEREAS, a public hearing was held on October 14, 1996 before the City Council in the City Hall after due published and posted notice had been given and all persons interested were given an opportunity to be heard; and, WHEREAS, it appears it will be for the best interest of the City to vacate such portion of the drainage and utility easement, and WHEREAS, four fifths of all the members of the Council concur in this resolution, NOW, THEREFORE, BE IT RESOLVED, that the drainage and utility easement legally described above and shown on the attached map is hereby vacated.
