HomeMy WebLinkAbout1996-142 Council ResolutionCITY OF LINO LAKES RESOLUTION NO. 96-142 RESOLUTION VACATING A PERPETUAL PONDING AND FLOWAGE EASEMENT OVER LOT 11, BLOCK 1, LINO AIR PARK NORTH AND ACCEPTING A REVISED PERPETUAL PONDING AND FLOWAGE EASEMENT OVER SAID LOT. WHEREAS, Carl Johnson, owner of the property legally described as Lot 11, Block 1, Lino Air Park North, has requested that the a perpetual ponding and flowage easement over his lot be reduced in size, and WHEREAS, the Rice Creek Watershed District originally requested said ponding and flowage easement and has since recommended its revision, and WHEREAS, a public hearing was held on October 14, 1996 before the City Council in the City Hall after due published and posted notice had been given and all persons interested were given an opportunity to be heard; and, WHEREAS, it appears it will be for the best interest of the City to vacate said perpetual ponding and flowage easement and accept a revised easement over Lot 11, Block 1, Lino Air Park North, and WHEREAS, four fifths of all the members of the Council concur in this resolution, NOW, THEREFORE, BE IT RESOLVED, that the perpetual ponding and flowage easement legally described by Kurth Surveying on August 15, 1996 be vacated and replaced by the following described perpetual ponding and flowage easement: All of Lot 11, Block 1, Lino Air Park North, Anoka County, Minnesota, except the following: Commencing at the northwest corner of said Lot 11; thence South 01 degree 10 minutes 25 seconds West, assumed bearing, along the west line of said Lot 11, 57.52 feet, thence North 88 degrees 45 minutes 51 seconds East, 15.01 feet to the actual point of beginning; thence continue North 88 degrees 45 minutes 51 seconds East, 90.00 feet; thence South 01 degree 14 minutes 09 seconds East, 174.00 feet; thence South 88 degrees 45 minutes 51 seconds West, 7.50 feet; thence South 01 degree 14 minutes 09 seconds East, 40.00 feet; thence South 88 degrees 45 minutes 51 seconds West, 90.00 feet; thence North 01 degrees 14 minutes 09 seconds West, 40.00 feet; thence North 88 degrees 45 minutes 51 seconds East, 7.50 feet; thence North 01 degree 14 minutes 09 seconds East, 174.00 feet to the actual point of beginning.
