City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike – The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4-minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more – groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice-Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. Occasionally, the Board may continue a hearing to another meeting before taking action. Meeting Etiquette The Planning & Zoning Board must preserve order and decorum while the meeting is in session. A resident shall not, by conversation or otherwise, delay or interrupt the proceedings or the business of the Board, nor disturb any resident or Board Member while speaking or refuse to obey the orders of the Board. DRAFT MINUTES CITY OF LINO LAKES PLANNING & ZONING BOARD MINUTES I. CALL TO ORDER AND ROLL CALL: Chair Tralle called the Lino Lakes Planning and Zoning Board meeting to order at 6:30 p.m. on February 10, 2016. II. APROVAL OF AGENDA Chair Tralle added swearing in new and returning members as well as election of Chair and Vice Chair to the agenda after Open Mike. III. APPROVAL OF MINUTES: October 14, 2015 Mr. Laden made a MOTION to approve the October 14, 2015 Meeting Minutes. Motion was supported by Mr. Evenson. Motion carried 4 - 0. (Tralle and Stoesz abstained.) January 13, 2016 Mr. Laden made a MOTION to approve the January 13, 2016 Meeting Minutes. Motion was supported by Mr. Evenson. Motion carried 4 - 0. SWEARING IN OF BOARD MEMBERS Mayor Jeff Reinert executed the Oath of Office to newly appointed board member Dale Stoesz and incumbent board members Neil Evenson and Michael Root. VI. ELECTION OF CHAIR AND VICE CHAIR Mr. Root made a MOTION to nominate Paul Tralle for the role of Chair. Motion carried 5 - 0. (Tralle abstained.) Mr. Laden made a MOTION to nominate Michael Root for the role of Vice Chair. Motion carried 4 - 0. (Tralle and Root abstained.) Paul Tralle has been appointed to the role of Chair and Michael Root has been appointed to the role of Vice Chair. VII. ACTION ITEMS A. Saddle Club Second Addition Final Plat Katie Larsen, City Planner, presented the staff report. Staff recommends approval of the Saddle Club Second Addition final plat subject to the following conditions: 1. All comments from City Engineer letter dated February 1, 2016 shall be addressed. 2. A Development Agreement shall be drafted by the City, executed by the City and the developer and recorded by the developer. 3. Black Berry Court shall be revised to one word, Blackberry Court. 4. Title Commitment: a. Royal Oaks shall transfer title to Dupont Holdings before the plat is approved and recorded. b. The title commitment legal description shall be revised to include Outlot B and C. The board and staff further discussed the following topics: • Agreements with Comcast and Marcel Eibensteiner • Connection to Foxborough • Lots on the Comcast site • Utilities in phase three Planning & Zoning Board February 10, 2016 Page 3 DRAFT MINUTES Marcel Eibensteiner was present at the meeting and addressed the board with updates on the lot sales and he ensured that everything is going well with the project. Mr. Laden made a MOTION to recommend approval of the final plat. Motion was supported by Mr. Root. Motion carried 5 - 0. (Tralle abstained.) VIII. DISCUSSION ITEMS A. Industrial District Outdoor Storage Requirements Michael Grochala, Community Development Director, presented the staff report. Staff is looking for guidance from the board. Input from the board included: • Visibility from the freeway • Duration restrictions for parked trailers • Taking care not to control business operations B. The school currently houses early childhood family education and early childhood special education; however, they are in need of additional space. The property address is 575 Birch Street. Construction is scheduled to start in June 2016 with substantial completion in December 2016. The Land Use Application is for the following: 2 • Conditional Use Permit (CUP) for schools (public and private) • Site and Building Plan Review This staff report is based on the followings plan sets: • Property survey prepared by Sunde Land Surveying dated 9/8/15 and received by the City on 2/5/16 • Civil plans prepared by Larson Engineering, Inc. dated 11/24/15 and received by the City on 2/5/16 • Architectural plans prepared by Wold Architects and Engineers dated 11/2/15 and received by the City on 2/5/16 • Geotechnical Exploration and Factual Engineering Report prepared by NTI, Inc. dated 11/30/16 and received by the City on 2/5/16 • Stormwater Calculations prepared by Larson Engineering dated 11/3/16 and received by the City on 2/5/16 • Lighting fixture details submitted by Nexus Solutions on 2/5/16 ANALYSIS Zoning and Land Use The property is zoned PSP, Public and Semi-Public and allows for schools (public and private) with a conditional use permit. The school is considered to have an existing conditional use permit because it was constructed prior to the July 1997 ordinance update. Any change involving a structural enlargement of the facility requires an amendment to the conditional use permit. The Planning and Zoning Board shall recommend a conditional use permit and the Council shall order the issuance of such permit only if it finds the following criteria have been met: 1. The proposed development application has been found to be consistent with the policies and recommendations of the Lino Lakes Comprehensive Plan including: a. Land Use Plan. b. Transportation Plan. c. Utility (Sewer and Water) Plans. d. Local Water Management Plan. e. Capital Improvement Plan. f. Policy Plan. g. Natural Environment Plan. The proposed school addition for early childhood education is consistent with the policies and recommendations of the comprehensive plan. 2. The proposed development application is compatible with present and future land uses of the area. The proposed school addition for early childhood education is compatible with present and future land uses. The property to the north is zoned PSP, Public and Semi-Public and is guided for park and open space. The property is part of the Anoka County Rice Creek Chain of Lakes Park Reserve. The properties to the west, east and south are zoned and guided for single family residential development. Single family homes exist in the surrounding neighborhood. 4 3. The proposed development application conforms to performance standards herein and other applicable City Codes. A Site and Building Plan Review has been completed and the proposed school addition meets zoning performance standards in regards to exterior building materials, setbacks, landscaping and parking with the approved conditional use permit. 4. Traffic generated by a proposed development application is within the capabilities of the City when: a. If the existing level of service (LOS) outside of the proposed subdivision is A or B, traffic generated by a proposed subdivision will not degrade the level of service more than one grade. b. If the existing LOS outside of the proposed subdivision is C, traffic generated by a proposed subdivision will not degrade the level of service below C. c. If the existing LOS outside of the proposed subdivision is D, traffic generated by a proposed subdivision will not degrade the level of service below D. d. The existing LOS must be D or better for all streets and intersections providing access to the subdivision. If the existing level of service is E or F, the subdivision developer must provide, as part of the proposed project, improvements needed to ensure a level of service D or better. e. Existing roads and intersections providing access to the subdivision must have the structural capacity to accommodate projected traffic from the proposed subdivision or the developer will pay to correct any structural deficiencies. f. The traffic generated from a proposed subdivision shall not require City street improvements that are inconsistent with the Lino Lakes Capital Improvement Plan. However, the City may, at its discretion, consider developer-financed improvements to correct any street deficiencies. g. The LOS requirements in paragraphs a. to d. above do not apply to the I- 35W/Lake Drive or I-35E/Main St. interchanges. At City discretion, interchange impacts must be evaluated in conjunction with Anoka County and the Minnesota Dept. of Transportation, and a plan must be prepared to determine improvements needed to resolve deficiencies. This plan must determine traffic generated by the subdivision project, how this traffic contributes to the total traffic, and the time frame of the improvements. The plan also must examine financing options, including project contribution and cost sharing among other jurisdictions and other properties, that contribute to traffic at the interchange. 5 h. The City does not relinquish any rights of local determination. CSAH 34/Birch Street is a “B” minor arterial road. The school is accessed via two main driveways off of CSAH 34 and there will be no changes to these driveways. The early childhood education program currently operates out of the existing school. There will be no additional students or teachers increasing traffic and no impacts to the traffic levels of service are anticipated. 5. The proposed development shall be served with adequate and safe water supply. The site is served by a 16” ductile iron watermain located along CSAH 34/Birch Street which can accommodate the demands of the proposed school addition. 6. The proposed development shall be served with an adequate and safe sanitary sewer system. The site is served by a 12” sanitary sewer line located along CSAH 34/Birch Street which can accommodate the demands of the school addition. 7. The proposed development shall not result in the premature expenditures of City funds on capital improvements necessary to accommodate the proposed development. No City funds are being expended on this project. 8. The proposed development will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. The proposed school addition for early childhood education is an allowed use within the PSP, Public and Semi-Public District with an approved conditional use permit. The addition will not generate excessive traffic, noise, smoke, fumes, glare or odors. 9. The proposed development will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. There are no natural, scenic or historic features on the existing site. Specific Conditional Use Permit (CUP) Requirements In addition to the administrative requirements of a conditional use permit, the following specific performance standards of Section 1007.130 (8)(a) must also be met: 1. Side yards shall be double that required for the district, but no greater than thirty (30) feet. 6 The standard side yard setback is 10 feet so a 20 foot setback is required. The proposed school addition is 500+ feet from the east property line. 2. Adequate screening from abutting residential uses and landscaping is provided in compliance with §1007.043 (17) of this Ordinance. The proposed school addition is more than 400 feet from the nearest residential property. No screening is required. 3. Adequate off-street parking and access is provided on the site or on lots directly abutting or directly across a public street or alley to the principal use in compliance with §1007.044 of this Ordinance and that such parking is adequately screened and landscaped from surrounding and abutting residential uses in compliance with §1007.043 (17) this Ordinance. The 200 existing parking stalls located off-street exceed the required 143 parking stalls and will adequately serve the existing school and addition. 4. Adequate off-street loading and service entrances are provided and regulated where applicable by §1007.045 of this Ordinance. There is no off-street loading associated with the proposed school addition. 5. The provisions of §1007.016 of this Ordinance are considered and determined to be satisfied. The provisions of 1007.016 are satisfied as noted above in this staff report. Site and Building Plan Review Site Plan The Site Plan Review Worksheet found in Attachment #6 provides detailed information regarding the site plan review. The proposed school addition meets the performance standards of the zoning ordinance with some minor revisions required. One component of the project is the reduced width of the existing driveway in front of the addition from 28 feet to 21 feet. The proposed width is adequate for temporary drop-off parking and drive lane. No parking shall be allowed within 30 feet of the east entrance or along the south side of the driveway. Grading Plan and Stormwater Management This project proposes to construct a total of 26,000± s.f. of new impervious surface area. The site will drain to an existing on-site BMP raingarden located on the northeast corner of the building. The raingarden located in the northwest corner of the site will be 7 expanded to manage and treat the increased stormwater run-off. RCWD has reviewed the stormwater management plan and erosion and sediment control plan and issued a CAPROC for Permit #15-094. A stormwater maintenance agreement shall be required. Public Utilities The site is served by a 16” ductile iron watermain and 12” sanitary sewer line located along CSAH 34/Birch Street which can accommodate the demands of the proposed school addition. Landscaping and Tree Preservation Plan The school was built in 1992 prior to the regulations of the current landscape ordinance. Existing landscaping consists of grass, trees and landscaped rain gardens. The new addition will match existing landscaping conditions and additional canopy cover, foundation landscaping and open area landscaping will not be required. Seven trees will be removed and two existing trees have already been relocated on site. Grass will be planted between the addition and sidewalk similar to existing building. Rain gardens will be planted with appropriate materials and landscaping. Seven replacement trees are required and shall be shown on the landscape plan. Irrigation is required for all grass and landscaped areas. Architectural Plans and Exterior Building Materials The addition meets the building type and construction for institutional facilities. Exterior materials include varying earth tone brick colors, prefinished aluminum coping and decorative glazed block, all similar to the existing building. Signage Any new monument or wall signage shall require a separate sign permit application. The maximum allowed impervious surface is 60%. The existing school plus the addition are proposed at 14.3% impervious. Public Land Dedication No cash in lieu of land dedication shall be required with the addition. Comprehensive Plan Resource Management System The Resource Management System Plan goal of preserving surface water quality is supported by the implementation of stormwater management BMP raingarden. Land Use Plan The Comprehensive Plan guides this property for civic/institutional use. The proposed school addition is consistent with the designated land use. Housing Plan The goals and policies of Housing Plan are not negatively impacted by the school addition. Transportation Plan Goals of the Transportation Plan are to ensure that street and roads are as safe as possible and to reduce unnecessary traffic. CSAH 34/Birch Street is a “B” minor arterial road. The school is accessed via two main driveways off of CSAH 34 and there will be no changes to these driveways. The early childhood education program currently operates out of the existing school. There will be no additional students or teachers increasing traffic and no impacts to the traffic levels of service are anticipated. Regional and local trails exist throughout the school property and no changes will be made to those. Sanitary Sewer and Water Supply Plan The site is served by a 16” ductile iron watermain and 12” sanitary sewer line located along CSAH 34/Birch Street which can accommodate the demands of the proposed school addition. 9 Community Facilities One goal of the Community Facilities Plan is to maintain first-class education for children of Lino Lake and provide learning opportunities for residents of all ages. The addition is for Early Childhood Family Education and Early Childhood Special Education. Wetlands There are wetlands within the stormwater ponds located to the east of the site. Per RCWD CAPROC, the project does not propose any wetland impacts. Floodplain There is Zone A floodplain along the east side of the site but there are no impacts. Stormwater Maintenance Agreement A Stormwater Maintenance Agreement is required. Site Improvement Performance Agreement A Site Improvement Performance Agreement is required. RECOMMENDATION Staff recommends approval of the conditional use permit and site plan review with the following conditions: 1. All comments from the City Engineer letter dated March 3, 2016 shall be addressed. 2. All comments from the Environmental Coordinator dated February 29, 2016 shall be addressed. 3. All comments from the Anoka County Highway Department letter dated (to be provided) shall be addressed. 4. A Stormwater Maintenance Agreement shall be required. 5. A Site Improvement Performance Agreement shall be required. 6. A separate Sign Permit shall be submitted to the City for review and approval. 7. Site Plan Review Worksheet: a. Location and screening of mechanical equipment shall be provided. 8. Sheet C2-Paving Plan: a. “No Parking” signs shall be installed along the south side of the driveway in front of the addition. b. “No Parking” signs shall be installed along the north side of the driveway 30 feet from the east entrance. c. “Drop Off Only” only signs shall be along the north side of the driveway. 10 9. Sheet C4-Utility Plan: a. Watermain shall be located and shown on plan sheet. 10. Sheet L1-Landscape Plan a. Sod shall be shown between the new addition and sidewalk. b. Irrigation plan shall indicate irrigation in sod area between new addition and sidewalk. c. Location and species of 7 replacement trees shall be shown. 11. Sheet A-Overall Site Plan a. The Lino Lakes Environmental Board met on February 17, 2016 and made the following recommendations concerning the Rice Lake Elementary Addition: • Sod is proposed for the pervious area groundcover around the building. The sod area must be irrigated. • There are 7 trees proposed for removal. Replace these trees with a species of tree acceptable to the city. Suggested new tree planting site in the green area to the South and East of the site. • Remove Honeysuckle from the planting plan. • A stormwater management plan must be submitted and accepted by the city. Particular attention should be paid to preventing construction site pollution of Rice Lake. • A snow removal plan must be submitted that keeps snow removal stockpiles out of the rain gardens. Right now the raingarden on the East side is filled with snow/parking lot soil and sand. • A path should be provided on the east raingarden. Right now softball players in the summer and children coming in from recess walk right through the existing raingarden compacting the soil and ruining the plants. Allrepairs shall be recorded in the SWPPP.13.If sediment escapes the construction site, off-site accumulations of sediment must be removed in a manner and at a frequencysufficient to minimize off-site impacts.14.All soils tracked onto pavement shall be removed daily.15.All infiltration areas must be inspected to ensure that no sediment from ongoing construction activity is reaching the infiltration areaand these areas are protected from compaction due to construction equipment driving across the infiltration area.16.Temporary soil stockpiles must have silt fence or other effective sediment controls, and cannot be placed in surface waters,including stormwater conveyances such as curb and gutter systems, or conduits and ditches unless there is a bypass in place forthe stormwater.17.Collected sediment, asphalt and concrete millings, floating debris, paper, plastic, fabric, construction and demolition debris andother wastes must be disposed of properly and must comply with MPCA disposal requirements.18.Oil, gasoline, paint and any hazardous substances must be properly stored, including secondary containment, to prevent spills,leaks or other discharge. Restricted access to storage areas must be provided to prevent vandalism. Storage and disposal ofhazardous waste must be in compliance with MPCA regulations.19.External washing of trucks and other construction vehicles must be limited to a defined area of the site. Runoff must be containedand waste properly disposed of. No engine degreasing is allowed onsite.20.All liquid and solid wastes generated by concrete washout operations must be contained in a leak-proof containment facility orimpermeable liner. A compacted clay liner that does not allow washout liquids to enter ground water is considered animpermeable liner. The liquid and solid wastes must not contact the ground, and there must not be runoff from the concretewashout operations or areas. Liquid and solid wastes must be disposed of properly and in compliance with MPCA regulations.
