That the Four Corners preliminary and final plat will create one new lot of 11 acres to be <br />legally described as Lot 1, Block 1, Four Comers; and three outlots: A (46.64acres), B (5.01 <br />acres), and C (1.08 acres). <br />CONCLUSIONS AND DECISION <br />Based on the foregoing, the Applicants' application for Preliminary and Final Plat, subject to the <br />following conditions of approval: <br />1) The property shall be rezoned to BP — Business Park. <br />2) The applicant shall pay a fee in lieu of parkland dedication in the amount of $4500 per acre <br />of the newly created lot (t I acres X $4500 = $49,500 total) prior to any formal City <br />authorization. <br />3) Prior to the execution of the Final Plat by City officials, the Developer shall enter into a <br />Developer's Agreement acceptable to the City Attorney and approved by the City Council that <br />delineates who is responsible for the design, construction, landscaping, and payment of the <br />required improvements for the Four Comers Final Plat with financial guarantees therefore. <br />4) Final grading, drainage and erosion control, sanitary sewer and stormwater management, <br />street and utility construction plans shall be submitted, reviewed and approved by the City <br />Engineer, meeting City Engineering Design Standards, prior to the recording of the Final <br />Plat. All changes and modifications to the plans requested by the City Engineer in a <br />memorandum dated May 30, 2018 and all subsequent memorandums regarding the plans <br />shall be incorporated into these documents before they are approved. <br />5) The applicant must obtain all other necessary City, State, and other governing body permits <br />prior to the commencement of any construction activity on the parcel including but not limited <br />to building permits, conditional use permits, etc. <br />6) Any plans for construction on the newly created parcel must comply with the Lake Elmo <br />Design Standards Manual and specific general site considerations and development standards <br />for specific uses within the Business Park District. <br />7) The site plan is subject to a storm water management plan meeting State, Valley Branch <br />Watershed District and City rules and regulations. All applicable permits must be obtained. <br />Maintenance access roads meeting City engineering design standards must be provided for all <br />storm water facilities. <br />Resolution No. 2018- <br />
