CITY OF LAKE ELMO <br />COUNTY OF <br />WASHINGTON STATE OF <br />MINNESOTA <br />RESOLUTION NO. 2020-075 <br />RESOLUTION ESTABLISHING AN EMERGENCY HIGH WATER DECLARATION ON LAKE <br />ELMO LAKE IN LAKE ELMO <br />WHEREAS, The City of Lake Elmo values the natural resources within the community and; <br />WHEREAS, The City Council is responsible to protect said natural resources within the bounds set forth in State law <br />and; <br />WHEREAS, Water Surface Management Standards as set forth in Minnesota Rule 6110.3700, Subp. 9 stipulates that <br />in situations of local emergency, temporary special controls may be enacted by a County, City or Town; and <br />WHEREAS, the City has determined that a lake water elevation above the DNR"s Ordinary High Water Level <br />(OHWL) of 885.6 feet (based on NGVD 1929) will cause damage to the natural resource and is the water level where <br />an emergency restriction would be declared; <br />NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Lake Elmo, Minnesota, that an <br />emergency high water restriction be declared on Lake Elmo, all watercraft shall operate at slow -no wake speed on the <br />entire lake, until the pumping of Legion Pond stops and once pumping stops if the lake level drops, 3 days later then <br />the no wake ends; <br />NOW THEREFORE, BE IT FURTHER RESOLVED that the City Council will direct City staff to inform the <br />public by posting a sign at the boat launch and sending a notification by email to the Lake Elmo Lake Association <br />informing them of the emergency high water restrictions; <br />NOW THEREFORE, BE IT FURTHER RESOLVED that the City Council directs staff to notify the Minnesota <br />DNR of these emergency restrictions as soon as possible. <br />APPROVED by the Lake Elmo City Council on this-' J ly 20 <br />B <br />Mike Pearson <br />Mayor <br />ATTEST: <br />he hnson <br />C1 Clerk <br />
