CITY OF LAKE ELMO <br />WASHINGTON COUNTY <br />STATE OF MINNESOTA <br />RESOLUTION NO.2020-100 <br />A RESOLUTION DECLARING ADEQUACY OF THE 45TH STREET PRIVATE <br />DRIVE PETITION FOR MUNICIPAL WATER SERVICE <br />AND DEFERRING FURTHER ACTION BY THE CITY <br />WHEREAS, a petition was received from the owners of real property residing at 9757 45th <br />Street North, 9759 45th Street North, and 9765 45th Street North, requesting municipal water service; and <br />WHEREAS, these properties are located in the Special Well Construction Area due to PFAS <br />contamination and remedies are available to address private well contamination from PFAS through the <br />Minnesota Pollution Control Agency; and <br />WHEREAS, preliminary cost estimates for the proposed improvements have identified that the <br />extension of municipal water service is not an economically feasible improvement without the receipt of <br />outside grant assistance to wholly or partially reduce the cost burden of the improvements on the <br />homeowners; and <br />WHEREAS, should the improvements be constructed, it is proposed to assess all or a portion of <br />the cost of these improvements pursuant to the City's Special Assessment Policy and Minnesota Statutes, <br />Chapter 429. <br />NOW, THEREFORE, IT IS HEREBY RESOLVED, <br />The Petition requesting the improvements is hereby declared to be signed by the required <br />percentage of owners of property affected thereby. This declaration is made in conformity to <br />Minnesota Statutes 429.035. <br />2.
