Council Member Smith seconded the motion, Council Ii1Ieinbers Park and Smith voted for. Alayor Johnston and Council Members Johnson and DeLapp voted against the motion. The motion failed. ,A10TION: Council Member Johnson moved to adopt Resolution no. 2007-09 A stmmnary of Ordinance no. 97-203. Council 11ember DeLapp seconded the motion. The motion passed unanimously. Consider adopting an ordinance no 97-204 to allow horses as an interim pennitted use in the PF Zoning District Senior Planner Ben Gozola reported the City Council is being asked to discuss an ordinance to allow horses as an interim use in the public facilities zoning district. The ordinance has come forward at the request of the planning Commission and City Council in response to a recent church request to allow the keeping of horses. The planner provided two ordinance options for Council consideration. Both are identical except that one would permit horses as an interim permitted use on all PF zone property. Bruce Callen. member of the Common Ground Church, stated the Church would like to move forward and get their horses back. Attorney Filla explained there is a potential problem to pen -nit horses in PF zoned property limited to churches only and not appropriate on all PF zone property. Ben Gozola passed on Pastor Mark Anderson's request that the fee paid for the Conditional Use Application, which was denied, be applied to the Interim Use Permit fee. The Council doesn't have the authority to refund an application fee. It was noted that an Interim Use Permit fee has not been established. A10TION: Council DeLapp moved to table this item until the next council meeting to provide time to consider' whether horses ii,ould be appropriate on all PFzoned property, or ii,hether horses should be limited to churches only. The motion passed unanimously Consider ado tins Ordinance no. 97-205 to amend regulations governing -non-agricultural low impact uses and to allow such as an interim Rermitted use in the HD -A -BP zoning district Senior Planner Ben Gozola reported the City Council is being asked to discuss an ordinance to amend the existing standards governing non-agricultural law impact uses and to make such uses an interim permitted use in the HD -A -BP zoning district. The ordinance came forward at the request of the Planning Commission and City Council in response to a recent application that prompted an examination of existing codes. Both the Planning Commission and Council felt that added flexibility may be needed in code to allow non-agricultural low impact uses on an interim basis within holding districts south of IO'h Street.
