LAKE ELMO CITY COUNCIL MINUTES <br />APRIL 7, 2020 <br />ITEM 9: DECLARING AND EXTENDING A PERIOD OF A LOCAL EMERGENCY <br />City Attorney Sonsalla reviewed options for declaring a location emergency and the authority it <br />give the City to conduct business without time consuming procedures normally required. <br />Councilmember Bloyer, seconded by Councilmember Nelson, moved TO ADOPT <br />RESOLUTION 2020-033 DECLARING A LOCAL EMERGENCY WITHA SUNSELT <br />CLAUSE TO END THE DECLARATIONAFTER THE FIRST MEETING INMAY. <br />Motion failed 3 — 2. (Dorschner, Pearson — nay) <br />ITEM 10: APPLEWOOD POINTE OF LAKE ELMO <br />Planning Director Roberts presented the request for a Comprehensive Plan amendment, Zoning <br />Map amendment and Preliminary Plat and PUD for the construction of a multi -story senior living <br />building in the Eagle Point Business Park. Alex Hall, United Properties, spoke on behalf of the <br />applicant and reviewed their position that this is the best use of the property. <br />Mayor Pearson, seconded by Councilmember McGinn, moved TO ADOPT RESOLUTION <br />2020 —013 APPR 0 VING AN AMENDMENT TO THE LAND USE PLAN IN THE <br />COMPREHENSIVE PLAN FOR THE SITE OF THE APPLEWOOD POINTE OF LAKE <br />ELMO ON THE CORNER OF HUDSON BOULEVARD AND EAGLE POINT <br />BOULEVARD. THIS LAND USE PLAN CHANGE WOULD BE FROMBP (BUSINESS <br />PARK) TO MU -BP (MIXED USE BUSINESS PARK), IS BASED ON THE FINDINGS <br />LISTED IN THE STAFF REPORT AND IS SUBJECT TO THE CONDITIONLISTED IN <br />THE STAFF REPORT. Motion passed 4 —1. (Dorschner — nay) <br />Mayor Pearson, seconded by Councilmember McGinn, moved TO ADOPT ORDINANCE <br />NUMBER 08-08-234 APPROVING THE REZONING OF SITE OF THE APPLEWOOD <br />POINTE OF LAKE ELMO ON THE CORNER OF HUDSONBOULEVARD AND EAGLE <br />POINT BOULEVARD FROMBP (BUSINESS PARK) TO MU -BP (MIXED USE <br />BUSINESS PARK). THIS APPROVAL IS SUBJECT TO THE CITYAMENDING THE <br />COMPREHENSIVE PLANLAND USE DESIGNATION FOR THIS SITE TO MU-BPAND <br />IS BASED ON THE FINDINGS LISTED IN THE STAFF REPORT. Motion passed 3 - 2. <br />(Bloyer, Dorschner — nay) <br />Mayor Pearson, seconded by Councilmember Nelson, moved TO ADOPT RESOL UTION <br />2 02 0 — 014 APPROVING THE PRELIMINAR Y PUD PLANAND PRELIMINAR Y PLA T AS <br />REQUESTED BY JENNIFER MASON (OF UNITED PROPERTIES) FOR PID# <br />33.029.21.44.0009 FOR THE PROJECT TO BE KNOWN AS APPLEWOOD POINTE <br />SENIOR LIVING TO BE LOCATED ON THE CORNER OF EAGLE POINT BOULEVARD <br />AND HUDSON BOULEVARD. THIS APPROVAL ALSO AMENDS THE EAGLE POINTE <br />BUSINESS PARK PUD TO ALLOW THIS RESIDENTIAL USE AND IS SUBJECT TO <br />RECOMMENDED CONDITIONS OFAPPROVAL AS OUTLINED IN THE STAFF <br />REPORT.
