10 <br />the cost thereof from Grantee. However, Grantee shall have no obligation to remove the Cable <br />System where it utilizes the system to provide other non-Cable Services and has any other authority <br />under Applicable Law to maintain facilitates in the public rights-of-way, or where Grantee is able <br />to find a purchaser of the Cable System who holds such authorization. <br /> <br />2.10 Continuity of Service Mandatory. It shall be the right of all Subscribers to receive Cable <br />Service in accordance with the terms of this Franchise and Applicable Law. In the event that <br />Grantee elects to overbuild, rebuild, modify, or transfer the system in accordance with Section 2.7, <br />or the City revokes or fails to renew the Franchise, Grantee shall make its best effort to ensure that <br />all Subscribers receive continuous uninterrupted service, regardless of the circumstances, while <br />the Franchise remains effective. In the event of expiration, revocation/termination, purchase, lease- <br />purchase, condemnation, acquisition, taking over or holding of plant and equipment, sale, lease, or <br />other transfer to any other Person, including any other grantee of a cable communications franchise, <br />the current Grantee shall cooperate fully to operate the system in accordance with the terms and <br />conditions of this Franchise for a temporary period sufficient in length to maintain continuity of <br />service to all Subscribers. <br /> <br />SECTION 3 OPERATION IN STREETS AND RIGHTS-OF-WAY <br /> <br />3.1 Use of Streets. <br /> <br />(a) Grantee may, subject to the terms of this Franchise and the City Code, erect, install, <br />construct, repair, replace, reconstruct and retain in, on, over, under, upon, across and along <br />the Streets within the City such lines, cables, conductors, ducts, conduits, vaults, <br />manholes, amplifiers, appliances, pedestals, attachments and other property and <br />equipment as are necessary and appurtenant to the operation of a Cable System within the <br />City. Without limiting the foregoing, Grantee expressly agrees that it will construct, <br />operate and maintain its Cable System in compliance with, and subject to, the <br />requirements of the City Code, including by way of example and not limitation, those <br />requirements governing the placement of Grantee’s Cable System; and with other <br />applicable City Codes, and will obtain, pay for and maintain all permits and bonds <br />required by the City Code in addition to those required in this Franchise. <br /> <br />(b) All wires, conduits, cable and other property and facilities of Grantee shall be so <br />located, constructed, installed and maintained as not to endanger or unnecessarily interfere <br />with the usual and customary trade, traffic and travel upon, or other use of the Streets of <br />City. Grantee shall keep and maintain all of its property in good condition, order and repair <br />so that the same shall not menace or endanger the life or property of any Person. Grantee <br />shall keep accurate maps and records of all of its wires, conduits, cables and other property <br />and facilities located, constructed and maintained in the City. <br /> <br />(c) All wires, conduits, cables and other property and facilities of Grantee, shall be <br />constructed and installed in an orderly and professional manner in accordance with all <br />applicable requirements of the City Code and Applicable Law. All wires, conduits and <br />cables shall be installed, where possible, parallel with electric and telephone lines. <br />Multiple cable configurations shall be arranged in parallel and bundled with due respect <br />for engineering considerations.
