15 <br />4.3 Removal after Abandonment or Termination. If Grantee has failed to commence <br />removal of System, or such part thereof as was designated by the City, within thirty (30) Days after <br />written notice of the City’s demand for removal consistent with Minn. Rules, Ch. 7819, is given, <br />or if Grantee has failed to complete such removal within twelve (12) months after written notice <br />of the City’s demand for removal is given, the City shall have the right to apply funds secured by <br />the Bond toward removal and/or declare all right, title, and interest to the Cable System for the City <br />with all rights of ownership including, but not limited to, the right to operate the Cable System or <br />transfer the Cable System to another for operation by it. <br /> <br />4.4 City Options for Failure to Remove Cable System. If Grantee has failed to complete <br />such removal within the time given after written notice of the City’s demand for removal is given, <br />the City shall have the right to exercise one of the following options: <br /> <br />(a) Declare all right, title and interest to the System for the City or its designee with <br />all rights of ownership including, but not limited to, the right to operate the System or <br />transfer the System to another for operation by it; or <br /> <br />(b) Declare the System abandoned and cause the System, or such part thereof as the <br />City shall designate, to be removed at no cost to the City. The cost of said removal shall <br />be recoverable from the security fund, indemnity and penalty section provided for in this <br />Franchise or from Grantee directly. <br /> <br />(c) Upon termination of service to any Subscriber, Grantee shall promptly remove all <br />facilities and equipment from within the dwelling of a Subscriber who owns such dwelling <br />upon his or her written request, except as provided by Applicable Law. Such Subscribers <br />shall be responsible for any costs incurred by Grantee in removing the facilities and <br />equipment. <br /> <br />4.5 System Construction and Equipment Standards. The Cable System shall be installed <br />and maintained in accordance with standard engineering practices and shall conform, when <br />applicable, with the National Electrical Safety Code, the National Electrical Code and the FCC’s <br />rules and regulations. <br /> <br />4.6 System Maps and Layout. In addition to any generally applicable mapping requirements <br />included in the City Code and required of other utilities, Grantee shall maintain complete and <br />accurate system maps, which shall include trunks, distribution lines, and nodes. Such maps shall <br />include up-to-date route maps showing the location of the Cable System adjacent to the Streets. <br />Grantee shall make all maps available for review by the appropriate City personnel. <br /> <br />SECTION 5 SYSTEM DESIGN AND CAPACITY <br /> <br />5.1 Availability of Signals and Equipment. <br /> <br />(a) The Cable System utilizes a fiber to the fiber node architecture, with fiber optic <br />cable deployed from Grantee’s headend to Grantee’s fiber nodes, tying into Grantee’s <br />coaxial Cable System serving Subscribers. The System shall pass a minimum of 750 MHz <br />(with a minimum passband of between 50 and 750 MHz) and shall be maintained to <br />provide to Subscribers a minimum of at least two hundred (200) or more activated
