28 <br />continuing regulatory jurisdiction and supervision over the Cable System and Grantee’s operation <br />under the Franchise. <br /> <br />8.3 Regulation of Rates and Charges. <br /> <br />(a) Right to Regulate. The City reserves the right to regulate rates or charges for any <br />Cable Service within the limits of Applicable Law, to enforce rate regulations prescribed <br />by the FCC, and to establish procedures for said regulation or enforcement. <br /> <br />(b) Notice of Change in Rates and Charges. Throughout the term of this Franchise, <br />Grantee shall give the City and all Subscribers within the City at least thirty (30) Days’ <br />notice of any intended modifications or additions to Subscriber rates or charges. Nothing <br />in this subsection shall be construed to prohibit the reduction or waiving of rates or charges <br />in conjunction with promotional campaigns for the purpose of attracting Subscribers or <br />users. <br /> <br />(c) Rate Discrimination Prohibited. Within any category of Subscribers, Grantee shall <br />not discriminate among Subscribers with regard to rates and charges made for any service <br />based on considerations of race, color, creed, sex, marital or economic status, national <br />origin, sexual preference, or (except as allowed by Applicable Law) neighborhood of <br />residence, except as otherwise provided herein; and for purposes of setting rates and <br />charges, no categorization of Subscribers shall be made by Grantee on the basis of those <br />considerations. Nevertheless, Grantee shall be permitted to establish (1) discounted rates <br />and charges for providing Cable Service to low-income, disabled, or low-income elderly <br />Subscribers, (2) promotional rates, and (3) bulk rate and package discount pricing. <br /> <br />SECTION 9 BOND <br /> <br />9.1 Performance Bond. <br /> <br />(a) Upon the Effective Date of this Franchise and at all times thereafter until the <br />Grantee has liquidated all of its obligations under this Franchise, the Grantee shall furnish <br />and file with Commission, on behalf of all Member Cities, a bond in the sum of One <br />Hundred Thousand and No/100 Dollars ($100,000.00) in such form and with such sureties <br />as shall be acceptable to the Commission (“Bond”). The Bond shall be conditioned upon <br />the faithful performance by Grantee of this Franchise and upon the further condition that <br />in the event Grantee shall fail to comply with any law, ordinance or regulation, there shall <br />be recoverable jointly and severally from the principal and surety of the Bond, any <br />damages or losses suffered by City as a result, including the full amount of any <br />compensation, indemnification or cost of removal of any property of Grantee, including a <br />reasonable allowance for attorneys’ fees and costs (with interest at prime rate plus two <br />percent (2%)), up to the full amount of the Bond, and which Bond shall further guarantee <br />payment by Grantee of all claims and liens against City, or any public property, and taxes <br />due to City, which arise by reason of the construction, operation, maintenance or use of <br />the Cable System. <br /> <br />9.2 Rights. The rights reserved by City with respect to the Bond are in addition to all other <br />rights the City may have under this Franchise or any other law.
