A-1 <br />EXHIBIT A <br />BUILDOUT COMMITMENT <br /> <br />Regarding the subdivisions on the list below, for those which the developer or builder has not <br />given another provider exclusive access or refused to provide access to the property and for those <br />not already built out, Grantee agrees (for underground developments) to extend its Cable System <br />promptly when the utility easement trenches are open for all companies to enter, and (for above <br />ground developments) when other utilities such as telephone or electricity are provided to the site, <br />provided all necessary permits are issued and the developer or the Member City imposes no <br />Unusual Conditions on such permits, or on Grantee’s use of such trenches. If the subdivision is <br />already served by utilities, Grantee will build it out promptly. “Unusual Conditions” means a <br />condition imposed by City or developer that requires conditions for cost sharing that are <br />extraordinary to the area. <br />Grantee will provide an annual update on its progress on each development listed below. <br /> <br />Constructed within 12 months of Franchise Agreement effective date: <br /> <br />1. Easton Village <br />2. Wildflower at Lake Elmo <br />3. Village Preserve <br />4. Southwind Diedrich-Reider <br />5. Hunters Crossing <br />6. Inwood <br />7. Hammes Estates <br />8. Boulder Ponds <br />9. Savona <br />10. White Oaks Savannah (Grant) <br />11. Gateway (Grant) <br />12. Hidden Meadows Phase I <br />13. Legacy at North Star <br />14. Northport <br />15. Royal Golf Club <br />16. Union Park (if developer actually starts this project) <br /> <br />Constructed within 36 months of Franchise Agreement effective date: <br /> <br />Build-out to these sites is contingent upon the developer’s schedule: <br /> <br />1. Hidden Meadows Phase 2 <br />2. Wyndham Village (if developer actually starts this project) <br /> <br />The following projects on the RWSCC list will not be included in this Exhibit because the <br />developer has an exclusive contract or bulk contract with another service provider: <br /> <br />1. Fields of Arbor Glen <br />2. Springs Apartment
