CITY OF LAKE ELMO <br />WASHINGTON COUNTY <br />STATE OF MINNESOTA <br />RESOLUTION NO.2021-093 <br />A RESOLUTION APPROVING COOPERATIVE AGREEMENTS WITH <br />WASHINGTON COUNTY FOR THE COUNTY STATE AID HIGHWAY <br />(CSAH)13 - PHASE 2 IMPROVEMENTS, FROM 800 FEET NORTH OF <br />34TH STREET NORTH TO 44TH STREET NORTH <br />WHEREAS, Washington County intends to construct the County State Aid Highway (CSAH) 13 <br />(Ideal Avenue N.) from 800 feet north of CSAH 14 (34th Street N.) to 44th Street N. in the Cities of Lake <br />Elmo and Oakdale, herein referred to as the "Project; and <br />WHEREAS, the County and City agree to share in certain local costs included in the Project as <br />detailed in the Cooperative Cost Share Agreement No. 14179; and <br />WHEREAS, upon completion of this project, the City shall own and maintain, without cost or <br />expense to the County, all improvements constructed under this project within City Right of Way as detailed <br />in the Cooperative Maintenance Agreement No. 14180; and <br />WHEREAS, a cooperative effort between the County and City is the appropriate method to facilitate <br />the construction of these improvements, project cost sharing, and facilitate the maintenance of the items <br />constructed by the Project; and <br />WHEREAS, this Agreement is made pursuant to statutory authority contained in Minnesota Statute <br />162.17 sub.I and Minnesota Statute 471.59. <br />NOW, THEREFORE, BE IT RESOLVED, <br />1. That Cooperative Agreement 14179 for the project costs of County State Aid Highway (CSAH) <br />13 (Ideal Avenue N.) from 800 feet north of CSAH 14 (34th Street N.) to 44th Street N., between <br />the City of Lake Elmo and Washington County, is hereby approved and the Mayor and City <br />Administrator are hereby authorized to execute the agreement on behalf of the City of Lake Elmo. <br />2.
