Subdivision property and the construction therein of certain public and private improvements. The <br />Developer has been granted permission by the City to grade the Subdivision property by a <br />separate Grading Agreement dated October 12, 2021 (the "Grading Agreement"), The Developer <br />has also been granted permission by the City to construct certain improvements on the <br />Subdivision property by a separate Site Improvement Agreement dated July 20, 2021 (the "Site <br />Improvement Agreement"). Unless separate written approval has been given by the City within <br />the plat or land to be platted, the Developer may not construct public or private Subdivision <br />Improvements or any buildings on the Subdivision Property until all the following conditions <br />precedent have been satisfied: <br />A. the Developer has executed and recorded with Washington County all drainage and <br />utility easements required for the Subdivision by the City Engineer and Public Works <br />Director in the City's standard form or the easements have been dedicated to the City in <br />the plat (with the exception of the drainage and utility easement that will be granted by <br />the Developer to the City for the internal site water main that will be executed and <br />recorded after the watermain is constructed); <br />B. this Agreement has been executed by the Developer and the City; <br />C. the required Security (as hereinafter defined) have been received by the City from or on <br />behalf of the Developer; <br />D. final construction plans and specifications have been submitted by the Developer and <br />approved by the City Engineer, <br />E. the Developer has paid the City for all legal, engineering, and administrative expenses <br />incurred by the City regarding the City approvals and has given the City the additional <br />City Engineering Administrative Escrow required by this Agreement; <br />F. the Developer has paid any outstanding assessments and taxes for the Subdivision <br />property; <br />2 <br />LA515-93-753821A <br />
