9. TIME OF PERFORMANCE. Subject to unavoidable delays including adverse <br />weather conditions, the Developer shall install all required Subdivision Improvements by <br />December 31, 2022, The Developer may, however, request an extension of time from the City, <br />and the City agrees to grant a reasonable extension for delays. Such extension will not be the <br />basis for placing the Developer in default based on the schedule of improvements. If the City <br />grants the time extension, it shall be conditioned upon updating the Security or escrow posted by <br />the Developer to reflect cost increases, if any, and amending this Agreement to reflect the <br />extended completion date. <br />10, MAINTENANCE DURING CONSTRUCTION. The Developer shall be responsible for <br />all maintenance of the Subdivision improvements until the Subdivision Improvements are <br />accepted by the City in writing. The Developer and its contractors must adhere to the City's weight <br />restrictions for all streets both inside and outside of the Subdivision, regardless of whether said <br />streets are included in the City's map of streets with weight restrictions and regardless of whether <br />said streets are fully constructed. The Developer also is responsible to perform gopher state one <br />utility locates for all underground utilities until the Subdivision Improvements are accepted in <br />writing by the City. Warning signs shall be placed by the Developer when hazards develop in <br />streets to prevent the public from traveling on same and to direct attention to detours, If and when <br />streets become impassable, such streets shall be barricaded and closed by the Developer. The <br />Developer and its contractors must keep Hudson Boulevard North and Lake Elmo Avenue open <br />to traffic at all times unless a right-of-way obstruction permit is obtained from the City for Hudson <br />Boulevard North or from Washington County for Lake Elmo Avenue. The Developer shall be <br />responsible for keeping streets within and outside of the Subdivision clean and clear of dirt and <br />debris that may spill, track, or wash onto the street from the Developers operations. The <br />Developer shall contract for street cleaning for streets within and immediately adjacent to the <br />Subdivision.
