CITY OF LAKE ELMO <br />WASHINGTON COUNTY <br />STATE OF MINNESOTA <br />RESOLUTION NO.2022-081 <br />A RESOLUTION ORDERING THE PREPARATION OF A FEASIBILITY REPORT <br />FOR THE OLD VILLAGE PHASE 7 STREET AND UTILITY IMPROVEMENTS <br />WHEREAS, the City is extending sanitary sewer to serve the existing properties in the Old <br />Village Municipal Urban Service Area to replace the use of private on -site sewage treatment systems; and <br />WHEREAS, the City approved the Old Village Capital Improvement Program in September <br />2016 to address the phasing plan for these improvements with the first six phases being constructed in <br />2015, 2016, 2017, 2018, 2021 and 2022; and <br />WHEREAS, the final phase of the Old Village Capital Improvement Plan, Phase 7, including the <br />extension of sanitary sewer along Legion Avenue, south of 30th Street, is programmed for construction in <br />2023; and <br />WHEREAS, the Old Village Capital Improvement projects also include drainage improvements <br />to continue addressing historic flooding issues in the Downtown area, the replacement of aged watermain <br />pipes and reconstructing the public streets that are disturbed during the work; and <br />WHEREAS, it is proposed to assess the benefiting properties for all or a portion of the cost of <br />the improvement, pursuant to the City's Special Assessment Policy and Minnesota Statues, Chapter 429. <br />NOW, THEREFORE, BE IT RESOLVED, That the proposed improvement, called the Old Village <br />Phase 7 Street and Utility Improvements, be referred to the City Engineer and FOCUS Engineering, to <br />complete a feasibility report in accordance with Minnesota Statues, Chapter 429 for the proposed <br />improvements, and to report to the council with all convenient speed advising the council in a preliminary <br />way as to whether the proposed improvement is necessary, cost-effective, and feasible; whether it should <br />be best made as proposed or in connection with some other improvement; the estimated cost of the <br />improvement as recommended; and a description of the methodology used to calculate individual <br />assessments for affected parcels. <br />ADOPTED BY THE LAKE ELMO CITY COUNCIL ON THE SIXTH DAY OF SEPTEMBER, <br />2022. <br />(Seal) <br />ATTEST: <br />Jule J&nsknj <br />Cit Clerk <br />CITY OF LAKE ELMO <br />By: 21z� L___dZK4_4 <br />Charles Cadenhead <br />Mayor <br />
